HomeMy WebLinkAboutKIN 98 070 Tender-Harbour Expan v ~.. · · · THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW BY-LAW NUMBER 1998 - 70 A BY-LAW TO ACCEPT A TENDER FOR THE EXPANSION OF THE KINCARDINE HARBOUR WHEREAS the Council for The Corporation of the Town of Kincardine deems it expedient to accept a tender for expanding the Kincardine Harbour. AND WHEREAS B.M. Ross & Associates Limited, Engineers for the Town of Kincardine have conducted an analysis of all tenders received for this project which analysis is attached hereto as Schedule "A" to this by-law; AND WHEREAS recommendations have been received from the Waterfront Construction Committee regarding negotiation with the tenderer in order to bring the tendered price within the Town of Kincardine's budget for this project, which recommendations are attached hereto as Schedule "B" to this by-law; NOW THEREFORE BE IT RESOLVED THAT the Council for The Corporation of the Town of Kincardine ENACTS as follows: 1. That the tender of Harold Sutherland in the amount of $1,209,036.87 less adjustments to be negotiated with Harold Sutherland, pursuant to Schedule "B", for a total tender price of $1,168,689.00 including all applicable taxes, be hereby accepted. 2. That the mayor and clerk be hereby authorized to sign, on behalf of the Council for The Corporation of the Town of Kincardine, any contracts and other documents required to authorize such work to commence, and to affix the corporate seal of The Town of Kincardine. 3. That this by-law be subject to all necessary approvals from the Federal Department of Fisheries and Oceans & Small Craft Harbours and the Canadian Coast Guard. 4. This by-law shall come into full force and effect upon its final passage. 5. This by-law may be cited as the "Harbour Project Tender Acceptance By- law".
