Home My WebLink About03 079 amend 911 road system - e e- e THE CORPORATION OF THE MUNICIPALITY OF KINC INE BY-LAW NO. 2003 - 79 BEING A BY-LAW TO FURTHER AMEND BY-LAW 2002-1~0, A BY-LAW RENAMING THE MUNICIPALITY OF KINCARD~NE ROAD SYSTEM (911) . I WHEREAS the Municipal Act, 2001, S.O. 2001, c. 25, Section I 11, as amended, gives lower tier municipalities the power to pass by-laws wit~in the sphere of jurisdiction dealing with highways; I AND WHEREAS The Municipality of Kincardine passed BY-Ia~ 2002-130, cited as the Municipality of Kincardine 911 Road Renaming System ~y-laW; AND WHEREAS the Council of the Municipality of KincardinelWishes to further amend By-law 2002-130; ¡ , NOW THEREFORE the Council of the Corporation of th~ Municipality of Kincardine ENACTS as follows: . 1. That the following clauses be added to By-law 2002 - 13 : i) The owner of the property shall ensure that every roperty has the assigned municipal number posted in accordance 'th the provisions of this By-law. ii) The owner of the property shall ensure that every umber shall be affixed or inscribed in plain and legible numbers a least 12.7 centimeters (5 inches) high and such numbers sh II be placed at the main entrance of the building and on the side f the building facing the street or highway, placed not higher tha the first story thereof. iii) Where the main building is located beyond 30 me rs (100 feet) of the highway allowance or the main building is obs ured from the highway by trees, buildings, crops, etc., the buildi g number shall be placed on a contrasting plate attached to a pos at a height of at least 1.5 meters (5 feet) above the ground at the f nt of the property line adjacent to the building's laneway, u obstructed by mailboxes, etc. iv) In the event that the owner of the property fails to st the building numbers as directed by the Emergency Planning o-ordinator, the municipal staff may enter upon the property and p st the building number in accordance with the By-law and the co shall be paid by the owner of the land in a like manner as taxes. .../2 By-Law No. 2003 - 79 I 911 Road Renaming System Amendment (2), BY-Iþw Page 2 of2 I ¡ ·e v) The owner of the property shall keep and maintain !in good condition the building number and, where applicabl~, the contrasting plates. vi) No person shall refuse to post the building numberwhen required to do so by the Emergency Planning Co-ordinator. vii) No person shall remove, deface, obliterate or destroy the building numbers and applicable plates installed in accordarce with item ii) & iii) of this By-law, except for the purpose of replaping said numbers and plates or correcting errors. viii) Any person who contravenes any provision of this ßy-Iaw is, upon conviction, guilty of an offence and is liable to any þenalty as provided in the Provincial Offences Act. 2. e' 3. 4. That certain municipal house numbers, as shown in the aµached Schedule "A" to this by-law, be changed for the purpose of uniformity. This by-law shall come into full force and effect upon its fi~al passing. , This may be cited as the "911 Road Renaming Systen(1 Amendment (2) By-Law".
