HomeMy WebLinkAboutKIN 98 047 Pking Lt Agre-Humble .. · · · THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW BY-LAW NUMBER 1998 - 47 OF THE CORPORATION OF THE TOWN OF KINCARDINE A BYLAW TO AUTHORIZE THE SIGNING OF A PARKING LOT BY-LAW AGREEMENT WITH LEANNE THOMSON & PETER HUMBLE WHEREAS the Council for The Corporation of the Town of Kincardine deems it advisable to enter into a parking lot agreement with Leanne Thomson & Peter Humble; NOW THEREFORE the Council for The Corporation of the Town of Kincardine ENACTS as follows: 1. That The Corporation of the Town of Kincardine enter into a parking lot agreement with Leanne Thomson and Peter Humble in consideration of the sum of One Dollar ($1.00). 2. That the mayor and clerk be authorized to sign on behalf of The Corporation of the Town of Kincardine, the agreement with Leanne Thomson & Peter Humble which is attached to this by-law and to affix the Town's Corporate seal as and when required. 3. This by-law shall come into full force and effect on it final passing. 4. This by-law may be cited as the "Harbour Street Grille Parking Lot Agreement By-law" . BETWEEN: THE CORPORATION OF THE TOWN OF KINCARDINE Hereinafter called the "Town" of the First Part, -and- LEANNE THOMSON AND PETER HUMBLE Hereinafter called the "Owner" of the Second Part. WHEREAS the Town deems it expedient to enter into an Agreement with Leanne Thomson and Peter Humble for the development of a parking lot. NOW THEREFORE THIS AGREEMENT WITNESSETH THAT in consideration of approval of the plans for the development on subject parcel of land by the The Corporation of the Town of Kincardine and sum of ONE ($1.00) DOLLAR, the receipt of which is hereby admitted, the Owner for himself and for all successors in title, HEREBY AGREES as follows: The Corporation of The Town of Kincardine agrees to fulfill the provisions hereunder noted: I. The Town agrees to sell (legal description to be provided) the land required for the west half of the Parking Lot (per legal description) to Leanne Thomson and Peter Humble for the fee of One Dollar ($1.00). 2. The Town agrees to provide the balance of rough fill for the subgrade of said proposed parking lot. 3. The Town agrees to waive future parking requirements for 217 Harbour Street, during such period of time as the site is used for restaurant purposes. 4. The Town agrees to refund Three Thousand Five Hundred Dollars ($3,500.00) previously paid by Leanne Thomson and Peter Humble under Parking in Lieu requirements. 5. The Town agrees to paint parking lines as required in the finished parking lot. The Owner agrees to fulfill the provisions hereunder noted. I. The owner agrees to construct and maintain the parking lot and indemnify the Municipality against all actions. 2. The owner agrees to provide proper and appropriate lighting for the parking lot. 3. The owner agrees to allow public parking without restriction in the proposed parking lot. 5. Prior to commencement of construction of the parking lot, the owner agrees that construction standards and site design be subject to mutual agreement by the owner and agencies of The Corporation of the Town of Kincardine 6. The owner agrees that this agreement be registered on title for #217 Harbour Street. 7. The owner agrees to pay for all surveying and legal costs associated with this proposal. This Agreement shall enure to the benefit of and be binding upon the parties hereto and their respective successors and assigns. The word "Owner" and the words "he" or "his" where used in this Agreement and in addition to its accepted meaning, shall mean and include an individual, an associate, a partnership or incorporated company construed as including the plural, and whenever the masculine is used herein it shall be construed as including the feminine. IN WITNESS WHEREOF the Town has hereto affixed its corporate seal attested to by the hands of its mayor and clerk this 3rd day of September, 1998.
