OF THE CORPORATION OF
THE TOWN OF KINCARDINE
A BYLAW TO AMEND BY-LAW 1989-58 BEING A BY-LAW TO
PROVIDE FOR RULES AND REGULATIONS CONCERNING THE
BLUEWATER TRAILER PARK
WHEREAS the Council for The Corporation passed By-law 1989-58 on the 1 st day of
May 1989 to establish certain Rules and Regulations to ensure the orderly operation of
the Bluewater Trailer Park;
AND WHEREAS the Council for The Corporation of the Town of Kincardine deems it
advisable to amend Section 21, Schedule "A" of By-law 1989-58;
NOW THEREFORE the Council for The Corporation of the Town of Kincardine
ENACTS as follows:
That Section 21 of Schedule "A" be rescinded and replaced with the following Section
21:
1.
No person shall erect or construct, unless in accordance with the Ontario Building
Code, any building, or addition to the camping unit or site, other than a flat
moveable deck; temporary fencing around such deck is permitted on the
understanding that such fencing is removable. Such construction though
temporary in nature shall, nevertheless, be aesthetically pleasing. Every person
shall restore the site to its original condition when either the trailer or the deck
and fencing is removed.
2. This by-law shall come into full force and effect on it final passing.
3. This by-law may be cited as the "Bluewater Trailer Park" Amendment By-law.

RULES AND REGULATIONS - BLUE WATER TRAILER PARK
The Blue Water Trailer Park requests a minor change to Section 21
of Schedule "A" pursuant to By-law 1989-58 to allow removable
railings (fence) to be erected onto decks beside the trailers at
the park. The decks and railing will conform to the present by-
laws governing deck railings in town. The decks will dismantle
easily and conform to the intent of being both aestheticly pleasing
and easily moveable.

Schedule ~ section 21 of By-law No. 1989-58 states:
"No person shall erect or construct any building or addition to the camping unit or site,
other than a flat, unfenced, moveable deck. Every person shall restore the site to its original
condition when either the trailer or the deck, or both, are removed." see attached.
The above, I assume means close to the ground. The O.B.e. requires railings on decks more
than two feet above grade; therefore this By-law may come into conflict, at which time the
O.B.e. overrides municipal by-laws.
The reason for having no hand rail is not known to me, possibly an aesthetic concern.
This department has no objection to an amendment to By-law 1989-58 which would allow
handrails.
