HomeMy WebLinkAboutKIN 98 037 Rd Close-Oktoberfst · · · · THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW BY-LAW NUMBER 1998 - 37 OF THE CORPORATION OF THE TOWN OF KINCARDINE A BYLAW TO TEMPORARILY CLOSE A STREET IN THE TOWN OF KINCARDINE FOR THE PURPOSE OF AN OCTOBERFEST EVENT WHEREAS in accordance with subsection 207(44) of the Municipal Act, R.S.O. 1990, Chapter MAS as amended, authorizes the councils of all municipalities to close on a temporary basis any highway under the jurisdiction of the municipality for such social, recreational, community, athletic or cinematographic purpose as may be specified by by- law: AND WHEREAS the Council for The Corporation of the Town of Kincardine deems it prudent to close a certain section of Charles Street to accommodate an Octoberfest event in the Town of Kincardine; NOW THEREFORE the Council for The Corporation of the Town of Kincardine ENACTS as follows: 1. That this Octoberfest event be designated as a community festival. 2. That, that part of Charles Street from Broadway Street to Mechanics, at the Maple LeafInn, be closed to all vehicular traffic during the period of August 14th to August 16th, 1998. 3. That the Kincardine Rotary Club shall cause to have erected barricades at Charles Street posted with "local traffic only" notices for all property owners who cannot obtain access to their property by reason of such closing. 4. That the Kincardine Rotary Club shall cause to have erected at each end of such highway or portion thereof, and where an alternative route deviates thererrom, a barricade upon which an adequate warning device shall be exposed and in good working order continuously rrom sunset until sunrise and at such points there shall be erected a detour sign indicating the alternative route and containing a notice that the highway is closed to traffic. .../2 · · · · By-law No. 1998 - 37 Octoberfest Event Road Closing Page 2 of2 5. Every person who uses a highway or portion of a highway so closed to traffic does so at his or her own risk and The Corporation of the Town of Kincardine is not liable for any damage sustained by a person using the highway or portion thereof so closed to traffic. 6. Every person who without lawful authority uses a highway or portion thereof so closed to traffic while it is protected in accordance with this paragraph, or who removes or defaces any barricade, device, detour sign or notice placed thereon by lawful authority, is guilty of an offence and is subject to the penalties as set forth in the Provincial Offences Act and is also liable to set The Corporation of the Town of Kincardine for any damage or injury occasioned by such wrongful use, removal or defacement. 7. This by-law shall come into full force and effect on it final passing. 8. This by-law may be cited as the "Octoberfest Temporary Road Closure By-law".
