OF THE CORPORATION OF
THE TOWN OF KINCARDINE
A BY-LAW TO ACCEPT A TENDER FOR
TOURIST INFORMATION BOOTH OPERATIONS
WHEREAS the Council for The Corporation of the Town of Kincardine deems it
expedient to accept a tender for the operation of the Tourist Information Booth in
the Town of Kincardine;
NOW THEREFORE the Council for The Corporation of the Town of Kincardine
ENACTS as follows:
1. That the tender of Kelly Jones in the amount of $16,500.00 including all
applicable taxes, be hereby accepted.
2.
That the mayor and clerk be hereby authorized to sign, on behalf of the
Council for The Corporation of the Town of Kincardine, any contracts and
other documents required and to affix the corporate seal of The Town of
Kincardine.
3. This by-law shall come into full force and effect upon its final passage.
4. This by-law may be cited as the "1998 Tourist Information Booth
Operations, Tender Acceptance By-law".
READ a FIRST and SECOND time this 21st day of May, 1998.
READ a THIRD time and finally PASSED this 21st day of May, 1998.

TOURISM OPERATION REQUIREMENTS
This AGREEMENT made this 21st day of May, 1998.
BETWEEN:
THE CORPORATION OF THE TOWN OF KINCARDINE
hereinafter called the "Town"
of the First Part,
-and-
SECOND PART
Hereinafter called the "Operator"
Of the Second Part.
WHEREAS the Town has contracted the operation of the tourist information facility to
the Operator;
AND WHEREAS it is expedient that the terms and conditions of this contract be
specified by agreement between the two parties;
NOW THEREFORE TIllS AGREEMENT WiTNESSETH THAT in consideration
of the premises and mutual promises and covenants hereinafter contained, the parties
hereby agree as follows:
1. The Operator shall operate the tourist information booth on behalf of the Town of
Kincardine.
2. The Town shall pay to the Operator an annual sum of$16,500.00 for this service.
This amount shall be paid at a rate of $2,285.00 per month for the months of June
to December 1998 and $500.00 will be held-back and paid following the
completion of the calendar of events in 1999.

The leaseholders acknowledges that they are and shall be the sole owners of the
business and anyone working in the building or associated with the building shall
be employees of the leaseholders and shall be paid accordingly.
4.
The Operator agrees that minimum hours of operation of the Tourist Information
Booth shall be:
(1) June, July, August and September, 9:00 a.m. to 6:00 p.m. (seven days per
week);
(2) October, November and December, 11 :00 a.m. to 5:00 p.m. (Friday, Saturday,
Sunday);
(3) Other hours as directed by the Tourist Committee;
and will be responsible to provide adequate staffing to suit these needs.
5. The Operator agrees to work 4 to 5 hours per week in January, February and the
first half of March to prepare the yearly event calendar and update various lists
and directories. These hours may be worked from the Operator's residence or any
other location approved by the Tourist Committee.

The Operator agrees that tourism is to be the number one priority, that only items
approved by the Tourist Committee may be displayed or sold at the Tourist Booth
and that no business, other than tourism, may be conducted at the Tourist Booth,
without the approval of the Tourist Committee.

Notwithstanding Clause (3) above, the Operator may, at its discretion, keep the
booth open for a longer period of time or for longer hours at its own expense.
8.
The Operator shall keep a log-book of all telephone calls.
9.
The Town shall be responsible for all grounds maintenance, capital expenditures,
utilities and other costs approved by the Tourism Committee.
10.
The Town shall be responsible for the purchase and maintenance of all office
furniture, office equipment and paper supplies.
11.
The Town agrees to provide property and liability insurance coverage on the
building.
12.
The Operator shall keep a "visitor log" of all visitors to the booth for statistical
purposes; such log to include, but not be limited to, origin of visitor and
destination of visitor. The statistical results of this log shall be provided to the
Town on a monthly basis.
13. The Operator shall compile events information and other information useful to the
visitors to the Town for use in the annual tourist guide sponsored by the Tourist
Development Committee. The Operator shall assist the Tourist Development
Committee in the compilation of the annual tourist guide.
14. The Operator shall maintain, in conjunction with the Recreation Department, an
up-to-date directory listing all Town service clubs, recreation program groups,
and other community services. The directory shall be updated annually to ensure
the information as to contact persons, phone numbers, etc. is kept current.
15. The Operator shall be accountable to Kincardine Town Council through the
Administrator who shall liaise with the Tourism Committee.
16. The term of this agreement shall be from June 1, 1998 to March 31,1999.

Either party may terminate this agreement with sixty (60) days written notice to
the other.
18. It is hereby agreed that correspondence between the two parties shall be addressed

This Agreement shall ensure to the benefit of and be binding on the respective
heirs, executors, administrators, successors and assigns of the parties hereto.
22.
Please note that the Town of Kincardine reserves the right to award to the lowest
or any other tender.
IN WiTNESS WHEREOF the Town has hereto affixed its corporate seal attested by
the hands of its Mayor and Clerk this 25th day of May 1998. Operator has hereunto set
hislher hand this 25th day of May 1998.
