HomeMy WebLinkAboutKIN 98 004 Amend No. 93 25 Wast . · · · THE CORPORATION OF THE TOWN OF KINCARDINE BY-LAW BY-LAW NO. 1998-04 A BY-LAW TO AMEND THE WASTE MANAGEMENT BY-LAW FOR THE TOWN OF KINCARDINE. WHEREAS By-Law No. 1993-20 was passed on the 2200 day of April 1993, to establish rules and regulations for waste management~ AND WHEREAS By-law No. 1993-25 was passed on the 6th day of May, 1993 to clearly establish the need for bag tags on solid disposable waste, privately taken to the landfill; AND WHEREAS the Council for the Corporation of the Town of Kincardine now deems it necessary to regulate waste, from residential areas, taken to the landfill in commercial-hauler-dumpsters~ NOW THEREFORE the Council for The Corporation of the Town of Kincardine ENACTS as follows: 1.0 That Section 4.0 of by-law 1993-25, is hereby rescinded and replaced with the following: 4.5 No person shall place disposable solid waste at the site unless such waste is packaged in accordance with the provisions of this by-law and a municipal bag tag affixed. 4.6 Industrial, Commercial and/or Institutional waste of sufficient size, volume or weight suitable for disposal in garbage bags or containers, shall be placed in the appropriate area of the landfill and need not have a bag tag affixed. In such cases the tipping fees established in the Town's Consolidated Fee By-Law shall be applied to each load. 4.7 Mixed loads from commercial-hauler-dumpsters, containing residential domestic garbage, will be prohibited from the landfill. 4.8 Commercial contractors shall be charged based on the weight of the load~ such charges are established in the Town's Consolidated Fee Amendment By-Law. 4.9 The properties at 200 Harbour Street, known as Cottrill Harbour Condominiums~ and, the properties at 385 Lambton Street, known as Forbes Lambton Court, shall be exempt from the provisions contained in section 4.7 of this by-law. . · · · By-law No. 1998-04 2.0 Every person who contravenes any provisions of this by-law is guilty of an offence and upon conviction shall be subject to the penalties as prescribed in the Provincial Offences Act, RS.O. 1990, Chapter P.33. 3.0 This by-law shall come into full force and effect upon its final passage. 4.0 This by-law may be cited as the "Waste Management Amendment 1998, By-law".
