BY-LAW
BY -LAW NO. 1998 - 02
A BY -LAW TO AUTHORIZE SIGNING OF A RENTAL AGREEMENT FOR
THE USE OF VICTORIA PARK
WHEREAS the Council for The Corporation of the Town of Kincardine deems it
advisable to enter into rental agreement with Norton International Inc.;
NOW THEREFORE the Council for The Corporation of the Town of Kincardine
ENACTS as follows:
1. That The Corporation of the Town of Kincardine enter into an agreement with
Norton International Inc. for the use of Victoria Park.
2. That the mayor and clerk be authorized to sign, on behalf of The Corporation of
the Town of Kincardine, the agreement with Norton International Inc. which is
attached to this by-law and to affix the Town's Corporate seal as and when
required.
3. This by-law shall come into full force and effect upon its final passage.
4. This by-law may be cited as the "1998 Norton Use of Victoria Park Agreement
By-law".
READ a FIRST and SECOND time this 15th day of January, 1998.
READ a THIRD time and FINALLY PASSED this 5th day of February, 1998.

This AGREEMENT made in triplicate this 5th, day of February, 1998.
BETWEEN:
THE CORPORATION OF THE TOWN OF KINCARDINE
Hereinafter called the "Town"
ofthe First Part,
-and·
NORTON INTERNATIONAL INe.
Hereinafter called the "Norton"
of the Second Part.
WHEREAS the Town deems it expedient to enter into a rental agreement with Norton
for the use of Victoria Park.
NOW THEREFORE THIS AGREEMENT WITNESSETH THAT in consideration
of the premises and mutual promises and covenants hereinafter contained, the parties
hereby agree as follows:
1. The Town agrees that Norton shall have use of the easterly one third (1/3) portion of
Victoria park for the day of July 4th, 1998 from 6 a.m. to 5 p.m..
2. Norton shall only have the use of the said portion of the park for the purpose of
hosting a fine craft show.
3. Norton shall be allowed to charge an admission fee to any persons entering the
resewed.pGftÌGn of the park.
4. Norton agrees to dispose of any refuse created by the event in accordance with the
Town's by-laws.
5. Norton agrees to erect temporary fencing around the event.
6. Norton shall supply adequate portable toileting facilities for the event participants and
patrons.
7. Norton shall pay a rental fee, payable to the Town, in the amount of $350.00,
including GST.
8. The rental fee shall be paid to the Town by June 15th, 1998.
9. The Town agrees to keep its wahsroom facilities, located in the Town Hall, open for
public use on the day of the event.
10. The Town shall allow temporary electrical hookups to be established by Norton.

11. Norton agrees that the opening and closing times of the event shall be 10:00 a.m. and
5:00 p.m., respectively.
12. Norton agrees to return the park to its original state no later than 12:00 noon, on July
5th. 1998.

IN WITNESS WHEREOF the Town has hereto affixed its corporate seal attested by the
hands of its mayor and clerk this 5th day of February, 1998. Norton has hereunto set his
hand and seal this 5th day of February, 1998.
