BY-LAW
NO. 2004 ·152
. BEING A BY-LAW DESIGNATING CERTAIN LANDS ITHIN
THE FORMER TOWN OF KINCARDINE, NOT T BE
A REGISTERED PLAN OF SUBDIVISION
(Lots 1, 2 Plan M-71 , former Town of Kincardi e)
WHEREAS the Planning Act, R.S.O. 1990 c. P13, Section 50 4) authorizes the
Council of a Municipality to pass a By-law designating any Plan of Subdivision, or
part thereof, that has been registered for eight years or m re, not to be a
registered Plan of Subdivision for the purposes of Subsecti n 50 (3) of the
Planning Act;
AND WHEREAS certain lots described on Registered PI n of Subdivision
M-71 are within the former Town of Kincardine in the Municipali of Kincardine;
AND WHEREAS the said Plan of Subdivision No. M-71 was registered in the
Registry Office for the Registry Division of the County of Bruc on the 7111 day of
May, 1979;
NOW THEREFORE the Council for The Corporation of t e Municipality of
Kincardine ENACTS as follows:
1. That the Registered Plan of Subdivision or parts thereof d scribed as follows
is hereby designated to be a Plan of Subdivision which sh II be deemed not
to be a Registered Plan of Subdivision for the purposes f Subsection 3 of
Section 50 of the Planning Act, R.S.O. 1990.
2. That the lands subject to this by-law are described as P Is 1-1 and 2-1,
Section M-71 , being Lots 1 and 2, Plan M-71 , in the Munici ality of Kincardine
(formerly the Town of Kincardine), County of Bruce.
3. That the Clerk of the Municipality of Kincardine shall cause a certified copy of
this by-law to be lodged in the office of the Minister and to e registered in the
Land Registry Office for the County of Bruce as required b the said Planning
Act, Sections 50 (26) and (28).
4. That notice of the passing of this by-law shall be given wi hin 30 days of the
passing, to the owners listed on the last revised assessm nt roll, as required
by the said Planning Act, Section 50 (29).
5. That the Council of the Municipality of Kincardine shall h ar in person or by
agent any person to whom a notice was sent and who w' hin 20 days of the
mailing of the notice applies to be heard, respecting the A endment or repeal
of this by-law.

6. This by-law shall come into full force and effect on its final p ssing.
7. This by-law may be cited as the "Lots 1 and 2, Plan M-71 (Former Town of
Kincardine) Deeming By-law."
READ a FIRST, SECOND and THIRD time and DEEMED TO BE PASSED this
6th day of October 2004.
