THE CORPORATION OF THE MUNICIPALITY OF KINC INE
NO. 2004 -151
BEING A BY-LAW DESIGNATING CERTAIN LANDS ITHIN
THE FORMER VILLAGE OF TIVERTON, NOT TO BE
A REGISTERED PLAN OF SUBDIVISION
(Lots 43, 44, Plan 123, fonner Village of Tivert n)

WHEREAS the Planning Act, R.S.O. 1990 c. P13, Section 50 ( ) authorizes the
Council of a Municipality to pass a by-law designating any Plan f Subdivision, or
part thereof, that has been registered for eight years or m re, not to be a
registered Plan of Subdivision for the purposes of Subsecti n 50 (3) of the
Planning Act;
AND WHEREAS certain lots described on Registered Pia of Subdivision
123 are within the former Village of Tiverton in the Municipality 0 Kincardine;
AND WHEREAS the said Plan of Subdivision No. 123 was egistered in the
Registry Office for the Registry Division of the County of Bruce n the 28th day of
October, 1874;
NOW THEREFORE the Council for The Corporation of th Municipality of
Kincardine ENACTS as follows:
1. That the Registered Plan of Subdivision or parts thereof de ribed as follows
is hereby designated to be a Plan of Subdivision which sha I be deemed not
to be a Registered Plan of Subdivision for the purposes of Subsection 3 of
Section 50 of the Planning Act, R.S.O. 1990.
2. That the lands subject to this by-law are described as Lot 43 and Lot 44, Plan
123, in the Municipality of Kincardine (formerly the Viii ge of Tiverton),
County of Bruce.
3. That the Clerk of the Municipality of Kincardine shall cause certified copy of
this by-law to be lodged in the office of the Minister and to b registered in the
Land Registry Office for the County of Bruce as required by he said Planning
Act, Sections 50 (26) and (28).
4. That notice of the passing of this by-law shall be given with n 30 days of the
passing, to the owners listed on the last revised assessmen roll, as required
by the said Planning Act, Section 50 (29).
5. That the Council of the Municipality of Kincardine shall hea in person or by
agent any person to whom a notice was sent and who with n 20 days of the
mailing of the notice applies to be heard, respecting the Am dment or repeal
of this by-law.

e 6. This by-law shall come into full force and effect on its final pa sing.
7. This by-law may be cited as the "Lots 43 and 44, Plan 123 ( ormer Village of
Tiverton) Deeming By-law."
