THE CORPORATION OF THE MUNICIPALITY OF KINC INE
NO. 2004 - 141
BEING A BY-LAW TO ACCEPT A TENDER FOR THE WORK REQUIRED TO
PROVIDE SANITARY AND WATER SERVICING FOR INVER URON PARK-
MUNICIPALITY OF KINCARDINE
(lavis Contracting Ltd.)

WHEREAS By-law No. 2004 - 17 authorized the Municipali of Kincardine to
enter into an agreement with Her Majesty the Queen in ight of Ontario
Represented by the Minister of Natural Resources to construct a extension to the
municipal water system and to provide a sewage pumping c amber inside the
boundary of Inverhuron Provincial Park and a sewage forc main from the
sewage pumping chamber to the Municipality's sewage disposal I system;
AND WHEREAS the tendered amount for the contract is $9t,174.82 over the
amount budgeted and authorized by Municipality of Kincardine By-law No. 2004-
17; I
AND WHEREAS Section 11 of the Municipal Act, 2001, S.O 2001, c. 25, as
amended, provides that a lower-tier municipality has the powe to pass by-laws
under the Spheres of Jurisdiction of public utilities - water pro uction, treatment
and storage and collection of sanitary sewage, and culture, par s, recreation and
heritage ; I

AND WHEREAS pursuant to the said Municipal Act, sectlt,ns 8 and 9 (1)
municipalities are provided with powers of a natural person t enable them to
govem their affairs as they consider appropriate and to enha ce their ability to
respond to municipal issues; . .
AND WHEREAS the Council for The Corporation of the Munici ality of Kincardine
deems it expedient to accept a tender to construct a chi rination building
complete with piping, electrical controls, monitoring and ala ing of equipment
and 670 metres of watermain and to supply and install a pre bricated sewage
pumping station and ancillary works and 800 metres of forcemai ;:
NOW THEREFORE the Council for The Corporation of t~e Municipality of
Kincardine ENACTS as follows: "I
1. That the tender of Lavis Contracting Limited, in the amount of
$553,280.95, inclusive of all applicable taxes, to p vide a sewage
forcemain and pumping station, watermain and rechlorin tion facility and a
watermain inside the park boundary, be herebyaccepte .
2.
That the Mayor and CAO be hereby authorized to sig , on behalf of the
Council for The Corporation of the Municipality of Kinca ine any contracts
and other documents required to authorize such work to commence.
3. This by-law shall come into full force and effect upon its Inal passage.
