HomeMy WebLinkAbout04 149 taxi licence delegation e e e e TIIE CORPORATION OF THE MUNICIPALITY OF KINC INE BY-LAW NO. 2004 - 149 BEING A BY-LAW TO DELEGATE THE AUTHORITY OF TH COUNCIL OF THE MUNICIPALITY OF KINCARDINE TO LICENCE, RE ULATE AND GOVERN THE OWNERS, BROKERS AND DRIVERS OF T ICABS AND LIMOUSINES TO THE KINCARDINE POLICE SERVIC S BOARD WHEREAS Section 150 of The Municipal Act, 2001, S.O. 2001, c. 25, as amended, authorizes councils of municipalities to pass by-laws for the licenci g, regulating and governing of businesses; AND WHEREAS the Council for The Corporation of the Munici lity of Kincardine adopted By-law No. 2003 -40, the "Taxi By-law 2003" on April 2, 2003 AND WHEREAS pursuant to the said Municipal Act, Section 159 (1) nd (2) authority is conferred on municipalities to delegate, with the consent of a police s rvices board, the power to licence, regulate and govern a business specified in the by-I w for that part of the municipality over which the Police Services Board has jurisdiction; AND WHEREAS the Kincardine POli,ce Services Board has consented to accept the duty of considering all applications to licence. regulate and govem the 0 ners, brokers and drivers of taxicabs and limousines used for hire for the transportatio of passengers in the Municipality of Kincardine; NOW THEREFORE the Council for The Corporation of the Municip lity of Kincardine ENACTS as follows: 1. That Council delegate to the Kincardine Police Services B rd its authority to consider all applications for taxi and vehicle licences and to r ulate and govern the owners. brokers and drivers of taxicabs and limo sines within the Municipality of Kincardine. That all duties assigned to the Council of The Corporation of the Municipality of Kincardine in By-law No. 2003-40 be hereby delegated to th Kincardine Police Services Board. 2. 3.
