A BY~LAW TO AUTHORIZE THE REFUND OF TAXES AND
CANCELLATION OF UNCOLLECTABLE ACCOUNT RECEIVABLES
WHEREAS Section 442, The Municipal Act, R.S,O. 1990, chapter m.45
authorizes municipal councils to refund taxes under certain circumstances;
NOW THEREFORE the Council for The Corporation of the Township of
Kincardine - Bruce - Tiverton enacts as follows:
1. THAT the taxes reduced as a result of Minutes of Settlement and
Assessment Review Court decisions as set out in Schedule "A" attached
hereto be and the same are hereby reduced or cancelled for the year
1999.
2. THAT the taxes as set out in Schedule "B" attached hereto be and the
same are hereby cancelled or reduced for the year 1998.
3. THAT the taxes as set out in Schedule "C" attached hereto be and the
same are hereby cancelled or reduced for the year 1999.
4.
THAT the NSF cheques as set out in Schedule "0" attached hereto and
deemed uncollectable be cancelled.
5.
THAT the Uncollectable Accounts Receivable as set out in Schedule "E"
attached hereto and deemed uncollectable be cancelled.
6. THIS by-law shall come into full force and effect upon its final passage.
7. THIS by-law may be cited as the "1999 Write-Off By-Law".
READ a FIRST, SECOND, and THIRD time and DEEMED TO BE PASSED this
22nd day of December, 1999.

MEMORANDUM OF AGREEMENT
BETWEEN
ONTARIO POWER GENERATION INe.
AND
THE TOWNSHIP OF KINCARDINE-BRUCE-TIVERTON
IN RESPECf TO
FUNDING ASSISTANCE FOR NUCLEAR EMERGENCY PREPAREDNESS
This Agreement sets out the essential elements of terms discussed between the
representatives of Ontario Power Generation Inc. (OPGI) and the Township of
Kincardine-Bruce- Tiverton for the provision of funding assistance by OPGI to the
Townships' nuclear emergency preparedness program,
1. Term. The parties accept that nuclear emergency preparedness is. and will continue
to be, a standing community responsibility, and OPGI therefore will commit to
supporting the Program on a long-term basis. The term of the agreement is for five
years commencing January 1,2000 and ending December 31, 2004. Subsequent term
funding will be subject to renegotiation by the parties.
2. Funding. OPGI will provide the Township of Kincardine-Bruce-Tiverton with
funding of up to $85,000 per year for the nuclear emergency preparedness program
for the years 2000 to 2004. The Township of Kincardine-Bruce- Tiverton will provide
a detailed invoice statement to OPGI. OPGI will then reimburse the Township of
Kincardine-Bruce- Tiverton for the actual nuclear emergency preparedness
expenditures up to $85,000 per year,
3. Purpose. All funds provided under this agreement by OPGI will be solely for the
purpose of supporting the nuclear emergency preparedness program including the
operation and maintenance of municipal operations centre telephone lines and the
automated telephone public alerting system in the contiguous zone.
4. Disclosure and Review, The Township of Kincardine-Bruce-Tiverton will provide
OPGI with an annual statement detailing how OPGI funds were expended. In
addition, a joint review of the nuclear emergency preparedness program will be
conducted annually by executive representatives of the Township of Kincardine-
Bruce- Tiverton and OPGI. A set of reporting measures is to be developed for the
purposes of setting and monitoring expectations, These measures will be used once
they are joint! y finalized,
5. Management. The Township of Kincardine-Bruce- Tiverton will have exclusive
responsibility for the financial and operational management of their nuclear
· emergency preparedness program.

6. Extraordinary Costs. Any extraordinary costs incurred by the Township of
Kincardine-Bruce-Tiverton for nuclear emergency preparedness beyond the operating
costs currently contemplated will be beyond the scope of this Agreement. Such
extraordinary costs will be subject to separate negotiations between both parties.
7. Binding Agreement. This Agreement will be binding on the parties and their
successors and assigns for the specified term.
