HomeMy WebLinkAbout02 045 rd close scot festival e e e e THE CORPORATION OF THE MUNICIPALITY OF KINC INE BY-LAW NO. 2002 - 45 A BY·LAW TO TEMPORARILY CLOSE STREETS T HOLD A KINCARDINE SCOTTISH FESTIVAL I , i I I WHEREAS in accordance with subsection 207(44) of the Munici~al Act, R.S.O. 1990, Chapter M.45, as amended, authorizes the councils of all munic*' alities to close on a temporary basis any highway under the jurisdiction of the munici ality for such social, recreational, community, athletic or cinema-graphic purpose as ay be specified in a ~- I AND WHEREAS the Kincardine Scottish Festival and Highland ames wishes to hold an event July 5-6, 2002 at Victoria Park in the Municipality of Kinca dine; NOW THEREFORE the Council for The Corporation of the Muni ipality of Kincardine I ENACTS as follows: ¡ , 1. That portion of Durham Market North from the intersection ith Queen Street to the intersection with Princes Street: that portion of Durha Market South from the intersection with Princes to Queen Street, that portion of Princes Street running from the southern entrance of the municipal parking lot to its southern dead end at the river bank; that portion of Russell street run ing from Princes Street to the Russell Street intersection with Victoria be clo d to all vehicular traffic on Friday July 5, 2002 from 6:00 p.m. until 2:00 a.m. aturday July 6, 2002. ! That the main street closure on Queen Street from the inte ection at Lambton Street to the intersection at Gordon Street and tha portion of Durham Market North from the intersection with Queen Street to the ntersection with Princes Street: that portion of Durham Market South from t e intersection with Princes to Queen Street, that portion of Princes Street runni g from the southem entrance of the municipal parking lot to its southern dead en at the river bank; that portion of Russell street running from Princes Street to he Russell Street intersection with Victoria; that portion of Victoria Street from IRussell to Lambton be closed to all vehicular traffic on Saturday July 6, 2002 from 7:00 a.m. until 11:00 p.m. i i The Kincardine Scottish Festival shall erect at each end I of such highway or portion thereof, and where an alternative route deviates t~erefore, a barricade upon which an adequate warning device shall be eXPOSed~and in good working order continuously from sunset until sunrise and at such points there shall be erected a detour sign indicating the alternative route and c ntaining a notice that the highway is closed to traffic. i I , 2. 3. 21 e e e e By-Law No. 2002 - 45 Scottish Festival 2002, Temporary Street Closure, By-Ia Page 2 of 2 Every person who uses a highway or portion of a highWa~ so closed to traffic does so at his or her own risk and The Corporation f the Township of Kincardine-Bruce-Tiverton is not liable for any damage su tained by a person using the highway or portion thereof so closed to traffic. , I Every person who without lawful authority uses a highway o~ portion thereof so closed to traffic while it is protected in accordance with this~ragraPh' or who removes or defaces any barricade, device, detour sign or no ice placed thereon by lawful authority, is guilty of an offence and is subject to th penalties as set forth in the Provincial Offences Act and is also liable to the he Corporation of the Municipality of Kincardine for any damage or injury ocC~sioned by such wrongful use, removal or defacement. ! i 6. This by-law shall come into full force and effect upon its fina~ passage. 7. This by-law may be cited as the ·Scottish Festival 200~, Temporary Street Closure, By-law·.
