HomeMy WebLinkAbout02 145 prohibit overnight camp e e e e TIlE CORPORATION OF TIlE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2002 - 145 BEING A BY-LAW TO PROHIBIT OVERNIGHT CAMPING IN PUBLIC PLACES AND MUNICIPAL PARKS OWNED BY THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE WHEREAS the Council for The Corporation of the Municipality of Kincardine deems it expedient to regulate the use of public places and parks in the Municipality of Kincardine; NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine ENACTS as follows: 1. For the Purpose of this By-law Definitions: a. "Council" means the Council for The Corporation of the Municipality of Kincardine. b. "Overnight Sleeping and Camping" shall include but not be limited to, sleeping or camping out in the open or by means of a motor vehicle, recreational vehicle, motorized home, slide-in camper, chassis- mounted camper, camper, tent, tent trailer, or travel trailer for the purposes of short term accommodation, between the hours of 9:00 p.m. and 8:00 a.m. c. "Park and/or Public Place" means playgrounds, playing fields, bowling greens, other recreational places, beaches, streets, laneways, road allowances, boulevards, all lands along or adjacent to any lake or river, grass plots, public squares and open spaces and shall include any place the public has, or is permitted to have, access to. 2. Overnight sleeping and camping is hereby prohibited in any park or public place owned by the Municipality of Kincardine with the exception of the Bluewater Trailer Park; and, Reunion Park for the annual Fish Kincardine Salmon Derby for a period of up to two weeks during the month of May. 3. For extraordinary events such as the old Boys and Girls Reunion, Council may, by resolution, grant exemptions to paragraph 2 of this by-law and the Event Provider shall be required to give public notice of the use of such lands for the event for four consecutive weeks prior to such extraordinary event. .../2 e e e e Prohibit Camping in Public Places and Municipal Parks By-law By-law No. 2002 -145 Page 2 4. Every person who contravenes any provisions of this by-law is guilty of an offence and is liable to a fine as outlined in Schedule "A" to this By-law. 5. This By-law shall be enforced by the By-law Enforcement Officer of the Municipality of Kincardine. 6. All by-laws inconsistent with this by-law are hereby repealed. 7. This by-law shall come into full force and effect upon its final passing. 8. This by-law may be cited as the "Prohibit Overnight Camping in Public Places and Municipal Parks By-law".
