HomeMy WebLinkAbout99 110 Encroachment Permit · · . · THE CORPORATION OF THE TOWNSHIP OF KlNCARDlNE-BRUCE-TIVERTON BY-LAW NO. 1999 -110 BEING A BYLAW TO REGULATE, CONTROL AND PROHIBIT CERTAIN ACTIVITY ON PUBLIC HIGHWAYS WITHIN THE JURISDICTION OF THE CORPORATION OF THE TOWNSHIP OF KINCARDINE-BRUCE-TIVERTON WHEREAS The Municipal Act R.S.O. 1990, Chapter M.45 Section 308 subsection 3, (and the amendments thereto) authorizes a Municipality to pass by-laws regulating, controlling, and prohibiting certain activity on highways within the jurisdiction of the Municipality; NOW THEREFORE the Council of The Corporation of the Township of Kincardine-Bruce- Tiverton deems it expedient to ENACT as follows: 1. Prior to a person/persons, commencing any work on an open road crossing or bore involving municipal property, he/she must first submit a written application to the municipality, with a deposit cheque payable to The Township of Kincardine- Bruce- Tiverton in the amount of: a) $500.00 for each gravel road crossing or bore; b) $1,000.00 for each hardtop road crossing or bore. The above cheques will be returned when these standards are met. c) For those businesses that regularly do cuts and fills on municipal property an annual deposit of $5,000.00 can be paid to the municipality to be used in lieu of the individual cheques listed in a) or b). A list of businesses that qualify for these deposits shall be approved by the Public Works Committee 2. Installation and restoration must be to Ontario Provincial and Municipal Standards and in accordance with The Township of Kincardine-Bruce-Tiverton Drawing No.1, File No 99001, dated June 22nd, 1999. 3. In the event the crossing is to facilitate drainage works, the Road authority will determine the size of the pipe required to facilitate this drainage. The municipality will supply up to a 200 mm pipe, 18 m long, at no cost to the applicant. The applicant is responsible for any additional costs incurred if a larger pipe is required. 4. Two-way traffic must be maintained with a minimum of disruption at all times unless alternate arrangements have been approved by the municipality. .. ./2 . . . . Encroachment Permit By-law By-Law No. 1999 - 110 Page 2 of 2 5. It is the applicant's responsibility to obtain all utility locates. If the road is to be closed the applicant MUST NOTIFY ALL ESSENTIAL SERVICES BEFORE commencement and AFTER completion of the work. 6. The Public Works Manager and/or delegate must be present before any work on a road commences. 7. The municipality assumes no liability for adequacy of outlet or damage to persons or property during construction of the crossing and/or bore or, as a result of the crossing and/or bore. 8. Excavations for auger pits must not be closer than 3.08 M to the shoulder of the road. They must be protected by barriers and fully enclosed when unattended. 9. Signage (Le. - Men at Work, Road Closed) of works carried out under an Encroachment Permit must be in accordance with the Traffic Control Manual for Roadway Work Operations when required. 10. The municipality will supply, at no cost to the applicant, road barricades (to be picked up at the municipal garage), if not supplied by Contractor. 11. The Township of Kincardine-Bruce-Tiverton will accurately locate all such crossings on a Township map, for ease in future locates. 12. If repairs to the pipe are required, due to damages that are the Township's responsibility, costs will be paid by the Township. 13. That all by-laws previously passed by the former Township of Kincardine, Township of Bruce, and Town of Kincardine in respect to Encroachments are hereby repealed. 14. This by-law to be cited as the "Encroachment Permit By-law".
