HomeMy WebLinkAbout99 094 Amend No. 76 13 Mamica NO. 1999 - 94 BEING A BYLAW TO AMEND BY-LAW NO. 76 -13, AS AMENDED, BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE FORMER TOWNSHIP OF BRUCE (LOT 11, CONCESSION 8, TOWNSHIP OF KINCARDINE-BRUCE-TIVERTON, FORMER TOWNSHIP OF BRUCE) WHEREAS Section 34 of the Planning Act, R.S.O. 1990, Chapter 13, authorizes the councils of municipalities to enact and amend zoning by-laws which comply with an approved official plan; AND WHEREAS The Corporation of the former Township of Bruce enacted Comprehensive Zoning By-law No. 76 -13, as amended; AND WHEREAS the Council of the Corporation of the Township of Kincardine- Bruce-Tiverton desires to amend By-Law No. 76 -13 as amended; NOW THEREFORE the Council for The Corporation of the Township of Kincardine-Bruce-Tiverton ENACTS as follows: 1. By-law No. 76-13, as amended, being the Comprehensive Zoning By-law for the Township of Bruce is hereby further amended by adding the following paragraphs (nn) and (00) to subsection 5.11 thereof: (nn) Notwithstanding their 'Rural - A' zoning designation, the lands delineated as 'A-44a' on Schedule 'A' to this By-law may be used for rural residential purposes in accordance with the 'Rural - A' zone provisions contained in this By-law, excepting however that: (i) the 'minimum lot area' shall be 2.2 acres (0.9 hectares); (ii) the 'minimum lot frontage' shall be 190 feet (58 metres); (iii) the zone provisions for minimum front yard, minimum rear yard, and minimum side yard, shall not apply to buildings and structures as they existed at the date of the passing of this By-law; and (iv) the maximum number of livestock units shall be restricted to 2 per acre. (00) Notwithstanding their 'Rural - A' zoning designation, the lands delineated as 'A-44b' on Schedule 'A' to this by-law shall be used in accordance with the 'Rural - A' zone provisions contained in this By-law excepting however that: (i) no residential buildings or residential structures shall be permitted. .../2 By-Law 1999 - 94 Amendment to Comprehensive Zoning By-Law 76 - 13 (Lot 11, Concession 8, former Township of Bruce.) Schedule 'A' to By-law No. 76-13, as amended, is hereby further amended by changing thereon from 'A' to 'A-44a' and 'A-44b' the zoning designation of those lands described as Lot 11, Concession 8, Township of Kincardine-Bruce-Tiverton (former Township of Bruce) which are outlined in the heaviest black line on the attached Schedule 'A'. 3. This By-Law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning Act, 1990. 4. This by-law may be cited as the "Lot 11, Concession 8, (Township of Bruce) Zoning Amendment, By-law." READ a FIRST, SECOND and THIRD time and FINALLY PASSED this 11 th day of August, 1999.
