BY-LAW
NO. 1999 - 23
A BYLAW TO AMEND BY-LAW 82-08, AS AMENDED, BEING THE
COMPREHENSIVE ZONING BY-LAW FOR THE TOWNSHIP OF
KINCARDINE
WHEREAS Section 34 of the Planning Act, RS.O. 1990, Chapter 13
authorizes the councils of municipalities to enact and amend zoning by-laws
which comply with an approved official plan;
AND WHEREAS the Council of The Corporation of the Township of
Kincardine-Bruce- Tiverton has enacted By-law No. 1982-08, a zoning by-law
enacted under Section 34 of the said Planning Act;
AND WHEREAS the Council of the Corporation of the Township of
Kincardine-Bruce- Tiverton desires to amend By-law No. 1982-08;
NOW THEREFORE the Council for the Corporation of the Township of
Kincardine-Bruce-Tiverton ENACTS as follows:
1. By-Law No. 82-08, as amended, being the Comprehensive Zoning By-Law
for the Township of Kincardine, as amended, is hereby further amended
by adding the following subsection to Section 9.3 thereof:
"9.3.39
Notwithstanding their 'A l' zoning designation, those lands
designated as 'A1-1999-23' on Schedule 'A' to this By-law,
may be used for non-farm residential purposes, in
compliance with the A 1 zone provisions contained in this by-
law, excepting however, that:
i) the minimum lot area shall be 1.5 hectares (3.7
acres);
ii) the minimum lot frontage shall be 84 metres (275
feet); and,
iii) "lot area" shall be defined as the total horizontal
distance within the lot lines of a lot.
2. Schedule 'A' to By-law No. 82-08, as amended, is hereby further amended
by changing thereon from 'A l' and 'EP' to 'A 1-1999-23' and "EP' the
zoning designation of Part of Lot 18, Concession 5, Township of
Kincardine-Bruce-Tiverton (former Township of Kincardine), as shown
outlined in the heaviest broken line on the attached Schedule 'A'.
3. This By-Law takes effect from the date of passage by Council and comes
into force and effect pursuant to the provisions of the Planning Act, 1990.

This By-law shall be cited as the "Part Lot 18, Concession 5, Former
Township of Kincardine, Travers/Murch Rezoning, By-law".
READ a FIRST, SECOND and THIRD time and FINALLY PASSED this 17th day
