A BYLAW DESIGNATING CERTAIN LANDS WITHIN THE TOWNSHIP
OF KINCARDINE-BRUCE-TIVERTON, NOT TO BE A REGISTERED
PLAN OF SUBDIVISION
WHEREAS
Section 50(4), Chapter P.13 of the Planning Act, R.S.O. 1990
authorizes the Council of a Municipality to pass a By-Law designating any Plan of
Subdivision, or part thereof, that has been registered for eight years or more, not
to be a registered Plan of Subdivision for the purposes of Subsection (3) of the
Planning Act;
AND WHEREAS
certain lots described on Registered Plan of Subdivision No.
121 (former Village of Tiverton) are within the Township of Kincardine-Bruce-
Tiverton.
AND WHEREAS
the said Plan of Subdivision No. 121 was registered in the

Registry Office for the Registry Division of the County of Bruce on the 18 day of
October, 1874.
AND WHEREAS
it is deemed expedient in order to adequately control the
development of land in the Municipality that a By-Law be passed pursuant to the
said Section 50(4);
NOW THEREFORE
the Council of the Corporation of the Township of
ENACTS
Kincardine-Bruce-Tiverton as follows:
1. That the Registered Plan of Subdivision or parts thereof described as follows
is hereby designated to be a Plan of Subdivision which shall be deemed not
to be a Registered Plan of Subdivision for the purposes of Subsection 3 of
Section 50 of the Planning Act, R.S.O. 1990.
2. That the lands subject to this By-Law are described as Lots 30, 31, 34 and
35, Registered Plan 121, in the Township of Kincardine-Bruce-Tiverton
(formerly the Village of Tiverton), in the County of Bruce.
3. That the Clerk of the Township of Kincardine-Bruce-Tiverton shall cause a
certified copy of this By-Law to be lodged with the County of Bruce and to be
registered in the Land Registry Office for the County of Bruce (No. 3) as
required by the said Planning Act, Sections 50 (26) and (28).
4. That notice of the passing of this By-Law shall be given within 30 days of the
passing thereof as required by the said Planning Act, Section 50 (29).
5. That the Council of the Township of Kincardine-Bruce-Tiverton shall hear in
person or by agent any person to whom a notice was sent and who within 20
days of the mailing of the notice applies to be heard, respecting the
Amendment or repeal of this By-Law.

6. This By-Law takes effect from the date of passage by Council and comes into
force and effect pursuant to the provisions of the Planning Act, 1990.
7. This by-law may be cited as the “Partial Deeming By-Law for Plan M121,
Village of Tiverton”.
