BEING A BY-LAW TO AMEND ZONING BY-LAW ~O. 2003-25,
BEING THE COMPREHENSIVE ZONING BY-LA~ FOR THE
MUNICIPALITY OF KINCARDINE
ONTARIO PENINSULA FARMS LTD, (NOTT FARMS [ONf'] LTD.) C/O TIKAL
AND ASSOCIATES, PART LOT 3, LOT 4, and PART LOT 5, ONCESSION 9,
(BEING E PT LOT 3, LOT 4 and W PT LO 5),
MUNICIPALITY OF KINCARDINE, (FORMER TOWNSHI OF KINCARDINE)
WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chap~er 13 authorizes the
Councils of Municipalities to enact and amend zoning by-laws vfhich comply with an
approved official plan; ,

AND WHEREAS the Council of the Corporation of the Municipality of Kincardine has
enacted By-law 2003-25, a zoning by-law enacted under Se¥ion 34 of the said
Planning Act; i

AND WHEREAS the Corporation of the Municipality of Kincardine pesires to amend By-
law 2003-25; ,
NOW THEREFORE the Council of the Corporation of the Munipipality of Kincardine
ENACTS as follows: i
Schedule 'A' to By-law No. 2003-25 as amended, is herebYiurther amended by
changing thereon from 'A l' to 'A 1-a' and 'A 1-k', the zoning esignation of those
lands described as Part Lot 3, Lot 4, and Part Lot 5, Conce sion 9, (being E pt
Lot 3, Lot 4 and W pt Lot 5), Municipality of Kincardine (for~er Township of
Kincardine) which are outlined on the attached Schedule 'A'i

2. By-Law No. 2003-25, as amended, being the Comprehensi~e Zoning By-Law for
the Municipality of Kincardine, is hereby further amended b~ adding the following
paragraphs to subsection 9.3 thereof:

9.3.10 (a)
Notwithstanding their 'A1' Zoning designation,ithose lands
described as Part Lot 4, Concession 9, Municipality of Kincardine
(former Township of Kincardine), and deliteated as 'A1-k' on
Schedule 'A' to this By-law may be used fo non-farm residential
purposes in compliance with the 'A l' Zone p ovisions contained in
this By-law, excepting however, that: !
(i)
The number of livestock units shall be Ilimited to 3.7 livestock
units per hectare. !

3. This By-law takes effect from the date of passage by Council :¡nd comes into
force and effect pursuant to the provisions of the Planning Act R.S.O. 1990.
4. This By-law may be cited as the "Amendment to Comprehen~ive Zoning By-law
2003-25, (Part Lot 3, Lot 4, and Part Lot 5, Concession 9, [being E pt Lot 3 and
W Pt Lot 5], Municipality of Kincardine [former Township of Kincardine)), By-Law.
Read a FIRST, SECOND and a THIRD time and FINALLY PASSED this 14th day of
May 2003.
