No. 2003 - 64
BEING A BY-LAW TO AMEND ZONING BY-LAW NO. 82-08,
BEING THE COMPREHENSIVE ZONING BY-LAIN FOR THE
TOWNSHIP OF KINCARDINE

MUNICIPALITY OF KINCARDINE, (FORMER TOWNSHlr OF KINCARDINE)

WHEREAS Section 34 of the Planning Act, R.S.O 1990, ChaRter 13 authorizes the
Councils of Municipalities to enact and amend zoning by-laws jNhich comply with an
approved official plan; ,

AND WHEREAS the Council of the Corporation of the Townsbip of Kincardine has
enacted By-law 82-08, a zoning by-law enacted under Section 3# of the said Planning
Act· '

AND WHEREAS the Corporation of the Township of Kincardine h~s restructured to now
be a part of the Corporation of the Municipality of Kincardine; :

AND WHEREAS the Corporation of the Municipality of Kincardin~ desires to amend By-
law 82-08;

NOW THEREFORE the Council of the Corporation of the Mu~icipality of Kincardine
ENACTS as follows:

1. Schedule 'A' to By-law No. 82-08 as amended, is hereby fulrther amended by
changing thereon from 'A1' to 'A1-2003-xx-a' and 'A1-2003~xx-b', the zoning
designation of those lands described as Part Lot 3, Lot 4, alnd Part Lot 5,
Concession 9, (being E Pt Lot 3, Lot 4 and W pt Lot 5), Muricipality of Kincardine
(former Township of Kincardine) which are outlined on the ~ttached Schedule 'A'.
2. By-Law No. 82-08, as amended, being the Comprehensivel Zoning By-Law for
the Township of Kincardine, is hereby further amended by ~dding the following
paragraphs to subsection 9.3 thereof:
9.3 (a)
Notwithstanding their 'A l' Zoning deSignation~, those lands
described as Part Lot 4, Concession 9, Mu icipality of Kincardine
(former Township of Kincardine), and deline ted as 'A1-2003-xx-a'
on Schedule 'A' to this By-law may be used f r non-farm residential
purposes in compliance with the 'A1' Zone ~rovisions contained in
this By-law, excepting however, that:
(i)
The number of livestock units shall bel limited to 3.7 livestock
units per hectare.

(b) Notwithstanding their 'A l' Zoning desigmation, those lands
described as Part Lot 3, Lot 4, and Part Lot 5, ¡Concession 9, (being
E Pt Lot 3 and W Pt Lot 5), Municipality ~f Kincardine (former
Township of Kincardine), and delineated ~s 'A1-2003-xx-b' on
Schedule 'A' to this By-law may be used for ~gricultural purposes,
in compliance with the 'A l' Zone provisions contained in this By-
law, excepting however, that:
(i) The construction of any new detacheq dwelling; accessory
dwelling; or residential dwelling of' any type shall be
prohibited.
3. This By-law takes effect from the date of passage by Counci' and comes into
force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990.

This By-law may be cited as the "Amendment to Comprehensive Zoning By-law
82-08, (Part Lot 3, Lot 4, and Part Lot 5, Concession 9, [beil'1g E Pt Lot 3 and W
Pt Lot 5], Municipality of Kincardine [former Township of Kin¢ardine), By-Law.
Read a FIRST, SECOND and a THIRD time and FINALLY PASSED this 14th day of
May 2003. '
