WHEREAS the Council for The Corporation of the Township of Kincardine-
Bruce- Tiverton deems it advisable to enter into a contract for the provision of
police services;
NOW THEREFORE the Council for The Corporation of the Township of
Kincardine-Bruce- Tiverton ENACTS as follows:
1. That The Corporation of the Township of Kincardine-Bruce-Tiverton enter
into an agreement with the Solicitor General for the provision of police
services for the Township of Kincardine-Bruce-Tiverton.
2. That the mayor and clerk be authorized to sign on behalf of The
Corporation of the Township of Kincardine-Bruce-Tiverton, the agreement
with the Solicitor General which is attached to this by-law and to affix the
Township's Corporate seal as and when required.
3. This by-law shall come into full force and effect upon its final passage.

AGREEMENT FOR THE PROVISION OF POLICE SERVICES
UNDER SECTION 10 OF THE POLICE SERVICES ACT, R.S.O. 1990, c. P.1S, as am.

(the "Municipality")

RECITALS:
(a) Under s. 4(1) of the Police &rvices Act, R.S.O. 1990, c. P.15, as am. (the "Act"), the
Municipality is required to provide adequate and effective police services in accordance with its
needs;
(b) Under s. 5 of the Act, the Municipality's responsibility for providing police services may be
discharged by entering into an Agreement with Ontario under s. 10 of the Act;
(c) The Municipality has expressed its intent to provide police services, in pursuance of its ~a-
responsibilities under s. 5 of the Act, by means of this Agreement, as evidenced by Pe3ôl..tivd ~ \Cl'-'

(d) This Agreement reflects the intent of the parties to provide a level of police services for the
Municipality as set out in the "Proposal for Policing Services," dated May 5th, 1999 (attached as
Schedule "B");
(e) This Agreement reflects the intent of the parties that the proportion of the total cost of
maintaining the South Bruce detachment of the Ontario Provincial Police (the "O.P.P.") paid by the
Municipality is directly attributable to the cost of providing police services in and for the,
Municipality;

NOW THEREFORE, in consideration of the premises and covenants herein, the parties agree as
follows:
1. The parties warrant that the recitals are true.
Definitions
2. In this Agreement:
(a) "Annual Budget" means a budgetary estimate of the Municipality's annual police costs,
showing the budgetary estimate for each component and the service levels and equipment and all
other matters prepared by Ontario, the O.P.P. or the Commissioner and submitted to the Board for
approval by the Municipality under this Agreement.
(b) "Annual Financial Statement" means a financial statement which presents the Municipality's
annual police costs incurred, in accordance with generally accepted accounting principles, subject to
this Agreement, prepared by Ontario, the O.P.P. or the Commissioner and submitted to the Board for
approval by the Municipality under this Agreement.

(c) "Board" means the Municipality's Police Services Board.
(d) "Commissioner" means the Commissioner of the O.P.P.
(e) "Detachment Commander" means the O.P.P. officer in charge of the South Bruce
Detachment.
(t) "Memorandum of Understanding" means the collective agreement negotiated from time-to
time between the Crown and the Ontario Provincial Police Association, pertaining to
compensation, benefits, and working conditions of the uniformed members of the O.P.P., up
to and including the rank of sergeant-major.
General Provisions

3. Ontario shall provide adequate and effective police services in accordance with the
needs of the Municipality in compliance with the terms and conditions of the Agreement. The
Municipality shall pay Ontario for the police services provided under this Agreement in accordance
with this Agreement.
4. The Commissioner shall ensure that the Detachment Commander responds
appropriately to the Board's objectives and priorities determined under s. 1 0(9)(b) of the Act.

5. For the purposes of s. 10(6) of the Act, the Municipality shall be deemed the
municipality in respect of which the O.P.P. are assigned to provide police services under this
Agreement which shall include the enforcement of mutually agreed upon by-laws. The parties shall
annually review this part of the Agreement with a view to revising or updating the list of by-laws
requiring O.P.P. enforcement, as set out in Schedule "E". Municipal Building Code violations
overseen by the Municipality's Building Code inspector and those by-laws related to animal control
will not form part of this Agreement.
6. The Commissioner shall cause the Detachment Commander or his or her designate to
report to the Board at mutually agreed upon intervals regarding the provision of police services in
and for the Municipality.
Service Levels
7. Ontario shall cause the Commissioner to assign police officers and other persons to
duties relating to the police services in and for the Municipality so as to meet the service level
requirements set out in Schedule "C" attached to and forming part of this Agreement.
8. Ontario shall cause the Commissioner to provide a minimum of 1,467 hours of actual
work per calendar year by the appropriately ranked persons at regular non-overtime rates for each
actual position as is outlined in Schedule "C". When less than I OWIo of the time of an actual position
is dedicated to providing service to the Municipality, the minimum cost shall be reduced
accordingly.
9". The parties shall yearly review the service levels as are found in Schedule "B" and
shall make the appropriate adjustments to the Annual Budget.
10. Ontario shall deliver to the Board at mutually agreed upon intervals a statement
concerning statistical information as required by the Board regarding police services provided under
this Agreement. Ontario shall ensure that appropriate records are kept to support and verify the
statement provided.

11. Ontario shall supply or cause to be supplied at Ontario's cost all vehicles and
equipment reasonably necessary and appropriate for the use of the O.P.P. in providing police
services under this Agreement. Appropriate amounts in respect of the depreciation of the capital cost
of such vehicles and equipment, if any, may be included in the Annual Budget.
12. The parties will enter into negotiations concerning the provision and payment of
appropriate buildings and rental agreements.

Cost of Police Services
13. On or before December 1 in each year, Ontario shalI prepare and deliver to the
Municipality for its review and approval, the Annual Budget for the following year (Schedule "D"),
together with sufficient documentation and information reasonably necessary to explain and support
the service levels, the adequacy of equipment and facilities and all other matters affecting the Annual
Budget. Unless and until the Annual Budget for any year is approved by the Municipality, the
Annual Budget for that year shall be deemed to be the Annual Budget for the previous year,
increased only by inflation determined in accordance with the change in the Ontario consumer price
index for the latest 12 month period at time of quarterly invoice, provided that any known increases
in wage rates or benefit levels pursuant to a collective agreement shall be used for those labour costs
rather than inflation. The Municipality and Ontario shall negotiate in good faith to resolve any
differences which may arise concerning the approval of the Annual Budget, with a view to resolving
any differences, no later than May 31 in the year to which it relates.
. 14. The Municipality shall make quarterly installment payments to Ontario on the last
days of March, June, September and December in each year, each being one quarter of the Annual
Budget for that year subject to adjustment in accordance with the Annual Financial Statement as set
out below. If any installment is made in respect of a calendar year before the approval of the Annual
Budget for that year, following the approval of the Annual Budget, at the time of the payment of the
next installment for that year, an adjustment shall be made so as to bring all installments in
conformity with the Annual Budget.

15. On or before March 31 in each year following a year to which this Agreement applies,
Ontario shall deliver to the Municipality for its approval an Annual Financial Statement for the
preceding calendar year. Ontario shall keep all records, statements of account, invoices and any
other such documents necessary to support the Annual Financial Statement, and all such records
shall be kept for a period of six years. Ontario shall permit the Municipality, upon notice to Ontario,
to examine all such records and books of account and conduct a review of the Annual Financial
Statement.
16. Should the Municipality fail to notifY Ontario ofits approval of the Annual Financial
Statement within 90 days following its delivery, it shall be deemed to be approved. Should the
Municipality deliver to Ontario a request to review the Annual Financial Statement within 90 days
following its delivery to them, it shall only be approved or amended and approved in accordance
with paragraph 17.
17. Where the Municipality has delivered to Ontario a request to review the Annual
Financial Statement, the Municipality shall carry it out expeditiously, and Ontario shall cooperate to
permit such a review to be carried out. If the parties are unable to agree on the Annual Financial

Statement, either PartY may submit the matter to the dispute resolution mechanism contained in
. paragraph 20.
18. Upon the approval, deemed approval or adjudicated approval of the Annual Financial
Statement, as provided in this Agreement, an adjustment shall be made in the amounts paid by the
Municipality by installment so that the total amount paid is equal to the amount as shown on the
approved Annual Financial Statement. Any amounts payable by one PartY to the other as a result of
such adjustment sha1l be paid within 60 days following the approval, deemed approval or
adjudicated approval of the Annual Financial Statement. Any amounts which have become due and
owing by one party or the other according to the adjustment shall bear interest at the rate set by the
Minister of Finance of Ontario, from time to time for the purpose of repayment of taxes, from 30
days following the date of invoice by one PartY to the other.

19, Despite anything in this Agreement, the total amount of money paid by the
Municipality for police services in respect of any calendar year shall not exceed the Annual Budget
for that year, whether approved or not, and the Annual Financial Statement shall be amended to
reduce or eliminate any such excess shown therein, with the exception of costs and expenses
incurred as a result of the following:
(a) an emergency where the emergency area includes the whole or any part of the Municipality
and an emergency has been declared under the Emergency Plans Act, R.S.O. 1990, c. E.9,
and all contributions to defray any costs incurred in that connection from any provincial or
federal government sources which may be reasonably expected have been accounted for,
(b) increases with respect to wages, benefits or other employment matters,
(c) property and plant, equipment and fuel,
(d) compliance with any laws, by-laws, regulations or provincial standards which become
applicable to this Agreement or the provision of police services following the approval of the
Annual Budget for that year, and

(e) any other matters which require the provision of municipal police setvices in the
Municipality and which were beyond the control of Ontario or the O.P.P., and which were
unforeseeable at the time of the approval of the Annual Budget,
and, in the event the Municipality decides to reduce the number of employees employed by the
Municipality in connection with this Agreement, the Municipality shall bear all costs and expenses
incurred as a result of any such reduction.

20. In the event a dispute arises between the parties regarding the interpretation, application,
administration or alleged violation of this Agreement, the Detachment Commander, or
representative, agrees to meet with the Board at the earliest available opportunity to discuss the
dispute. If the dispute remains unresolved at the Detachment level, the Regional Commander, or
representative, agrees to meet with the Board at the earliest available opportunity. If the dispute
remains unresolved at the Regional-level, the Commissioner (or a Deputy Commissioner, in the
absence of the Commissioner) agrees to meet with the Board at the earliest available opportunity.
Notice
21. Any notice, statement, invoice or account to be delivered or given by any of the
below listed groups to any other of them shall be delivered to all other groups in writing and sent by
mail addressed to those groups at their respective address as listed below, or sent by fax transmission
to the fax number listed below. Any notice, statement, invoice or account sent by mail shall be
deemed to be received on the third day fol1owing the date of mailing unless shown to the contrary
and if sent by fax shall be deemed to be received on the date of transmission. Any group may
change its address and fax number by giving notice provided herein:

CommeDcemeDt and Termination of Al!I"eemeDt

22. This Agreement comes into force on the 1st day of May, 1999, and shall conclude on
the 1- day of May 2004.
23. Either party to this Agreement may terminate this Agreement upon one year written
notice of termination to the other party, in which case this Agreement shall terminate one year
fol1owing the delivery of such notice. Should a notice to terminate be given, the Municipality shall
continue to be obligated to pay for the cost of providing police services under this contract to and
including the date of such termination and Ontario shall continue to be responsible to provide the
services outlined in this Agreement.

24. Should the Municipality's designated responsibility to provide policing under the Act
be changed, either by statute or government interpretation, the Municipality maintains its right upon
being so informed to give written notice of its intention to terminate this Agreement forthwith.
Entire Al!:reement
25. This Agreement and the schedules attached constitute the entire Agreement between
the parties, and there are no representations, warranties, collateral agreements or conditions affecting
this Agreement or the relationship of the parties or supported hereby other than as expressed herein
in writing. Any amendment to this Agreement must be in writing, duly executed by the parties.
IN WITNESS WHEREOF, the Municipality has affixed its Corporate Seal attested by the
signature of its duly authorized signing officers and the Solicitor General has personally'signed this
Agreement to be effective as of the date set out her ' .

Executive Summary
-
In 1999 the Ontario Provincial Police (OPP) will celebrate its' 90" Anniversary. The OPP is well known
and respected for providing effective community-based policing and protection throughout Ontario.
The OPP has also provided municipal policing services under contract for over 50 years and currently
maintains contracts with over 60 communities across Ontario.
The South Bruce OPP Detachment has provided adequate and effective community based policing
under contract to the former Town of Kincardine since May 1994.
The OPP undertook the development of this proposal based on direction from a special Committee of
Council for the new Township of Kincardine-Bruce- Tiverton. The new municipality includes the former
Townships of Bruce and Kincardine, the Town of Kincardine, and the Village of Tiverton. This proposal
is based on the level of policing services required to provide adequate and effective policing, and
includes an in-depth analysis of the workload generated in the municipality during the past two years.
This allows the OPP to compare local occurrences and incidents with provincial averages to accurately
determine the number of officers required. This workload methodology has been in place since 1991
and has met the approval of the Ontario Civilian Commission on Policing Services (OCCPS).
Based on this information the Township of Kincardine-Bruce-Tiverton, requires both pro-active and re-
active policing, 24 hours a day, seven days a week. The South Bruce OPP Detachment, specifically
the Kincardine Detachment will remain as the Administration/Operations. Centre. The resources
identified will continue to be deployed to the Municipality from this facility.

The following Policing Model is put forward for your consideration. This Policing Model includes bylaw
enforcement.
TOWNSHIP OF KINCARDINE-BRUCE-TlVERTON POLICING MODEL:
e Proposes a dedicated Constable comDlement of fourteen (141. one 11} dedicated Seraeant. One
.'-'" (1) dedicated Secretary Is also Identified. This particular Secretary remains an employee of the
Township of Kincardine-Bruce-Tiverton. Other administrative and support resources would be shared.
Policing of Kincardine-Bruce- Tiverton will be maintained as a dedicated patrol zones of the Kincardine
Operations Centre. Actual officer deployment and dedicated hours to patrol urban portions of the
municipality will be as directed by the Police Services Board in consultation with the Detachment
Commander.
The estimated costs associated to this model. based on the 1999 salary schedule for OPP officers is

This' proposal reflects the integrated policing concept, incorporating a policing services contract for the
Township of Kincardine-Bruce- Tiverton with OPP highway patrol services and provincial
responsibilities under one administration, The South Bruce OPP Detachment Commander would be
responsible to oversee all aspects of service delivery. The OPP contract complement identified in this
proposal would be assigned to the policing needs of the Township of Kincardine-Bruce- Tiverton.
Administrative and support resources would be shared and costed accordingly. The Detachment
Commander and Sergeant-Team Leaders would provide assistance and supervision to the identified
complement.
In order to provide a location for the police and public to interact, and to facilitate the delivery of
policing services in a community, the OPP encourages the establishment of Community Policing
Offices (CPOs). In the past, members of Council, members of the community, and members of the
South-Bruce OPP Detachment, have expressed concerns relating to youth in the downtown area of
Kincardine. A Community Policing Office located on Queen Street in Kincardine would assist in
addressing those concerns. A Community Policing Office is presently in use within the Township at
Tiverton. It is recommended this Office be maintained. Where such offices do exist they are usually
equipped with telephone and OMPPAC capabilities for use by officers assigned to the municipality.
Any decision on the establishment of an additional CPO in the Township of Kincardine-Bruce-Tiverton
rests entirely with Township Council and any associated costs will be the responsibility of the
Township.
It is recommended that the current Kincardine Detachment facilities remain as the Adminstration and
Operations Centre. Officers will be deployed from this location to policing zones within the Township.
Should the Township of Kincardine-Bruce- Tiverton have vacant buildings, or acquire new buildings,
that would be suitable as an Administration/Operations Centre, the OPP would be prepared to
determine that suitability.
The contract costs include all services available to the Township of Kincardine-Bruce·Tiverton. For
example, expenses relating to contract negotiations, arbitration, grievances, civil litigation,
tendering/purchasing, information technology, fleet and telecommunications are included in the overall
costing formula. These services often require considerable internal and external expertise and, the
high costs associated to such services are no longer of concern to municipalities that contract for OPP
service.
The salary costs outlined in this proposal are based on the first class pay level of each rank. These
costs are adjusted annually to reflect actual costs for those officers not at the maximum levels in their
salary grid. Overtime is estimated at the provincial average of 7% and this, too, will be reconciled to
actual usage at year-end.
All existing community service programs and community policing committees will be maintained.
When a municipality chooses to receive police service from the OPP under contract. the OPP will
ensure that the required resource levels are met. The shared infrastructure of the OPP broadens local
access to resources, expertise, solutions, training and management without duplicating services. In
this case, the Township of Kincardine-Bruce-TlVerton will continue to benefit as additional staff are
readily available from within the South Bruce OPP Detachment as well as neighbouring detachments
and regions, should the need arise.

The Township of Kincardine-Bruce-Tiverton will be required to establish a Police Services Board, as
mandated by the Police Services Act and will have control over the priorities and objectives of the
policing service within the community. The Commissioner is committed to ensuring that the
Detachment Commander of the South Bruce OPP Detachment responds appropriately to the
Board's advice and priorities in a manner consistent with the Board's identified concerns,
expectations and needs.
It is long-standing OPP policy and practice to be accountable to the communities we serve. The
Commander of the South Bruce OPP Detachment, or designee, will report to the Police Services
Board on a regular basis, as per the direction of the Board. The OPP is experienced in being
accountable to the municipalities we serve. With over 60 contracts currently in place and future
contracts pending, there is great emphasis placed on OPP accountability to Police Services
Boards.
Future growth and/or increased workload in the Township of Kincardine-Bruce-Tiverton may
necessitate additions to the proposed complement during the term of the contract. Any required
increase in complement would be negotiated between the participating municipalities and the OPP,
prior to any changes to the contract.
Advantages to the Township of Kincardine-Bruce-Tiverton:
· assurance of the adequacy of the police service;
· dedication to resolving community issues through local involvement and community policing
committees;
· service at a defined cost;
· availability of additional staffing support from neighbouring detachments, regional headquarters and
general headquarters;
· seamless access to a comprehensive infrastructure and specialized services (refer to Municipal
Policing Framework for description of support and services available); and
· control of the policing priorities and objectives through the Township of Kincardine-Bruce-Tiverton
Police Services Board.
The OPP is required to provide provincial level emergency response that can be mobilized in times of
emergency, disaster or specialized investigative need. The OPP meets such emergent needs, on an
on-call, as-needed basis, by deploying small numbers of officers from multiple locations and
assignments, both municipal and provincial. In so doing, the OPP ensures that appropriate levels of
service remain in place. Municipalities are compensated for the contract resources mobilized in cases
where there is a provincial obligation to respond.
If the Township of Kincardine-Bruce-TlVerton chooses to accept an OPP contract for its policing
service, the South Bruce OPP Detachment will assign resources, focusing on meeting the
Municipality's unique policing needs.
Salary, overtime, contractual payouts and telephone costs are reconciled at year end to reflect actuals.
A breakdown of the costs has been included, as well as the 1999 salary and cost schedule.

O.P.P. AUXILIARY POLICING PROGRAM
The parties agree to the provision of three members within the O.P.P. Auxiliary
Policing Program dedicated to the Township ofKincardine-Bruce-Tiverton. Two
members will be attached to the Huron Auxiliary Unit, with the remaining one member
attached to the Owen Sound Auxiliary Unit. Individual training will be received at
appropriate O.P.P.locations.
The parties agree that the O.P.P. has training and operational standards that must
be understood and met before these three individuals can commence duty with the O.P.P.
The parties agree that for the purpose of this agreement these three members will
accompany O.P.P. members assigned to patrol the South Bruce O.P.P. detachment area,
and wilJ Dot be limited to patrols, solely within the boundaries of the Township of
Kincardine-Bruce- Tiverton. The parties agree further that in some situation, ego Air
Shows, Fairs, emergency situations, etc., the Township may receive at no cost the
services ofO.P.P. Auxiliary personnel other than these three.
The cost of this program is based on a one time cost of $1500.00 per member for
uniform and equipment. An additional cost of$300.00 per member will be paid annually
by the Township to reimburse costs for meals, travel, and administration expenses. These
costs will be forwarded direct to the respective mentioned O.P.P. Auxiliary Units at the
commencement of this agreement and annually thereafter.

BEING A BYLAW TO AMEND BY·LAW 1999-80 TO PROVIDE AN
ADDENDUM TO THE EXISTING AGREEMENT WITH THE SOLICITOR
GENERAL RESPECTING POLICING ADEQUACY REQUIREMENTS
WHEREAS the Council for The Corporation of the Municipality of Kincardine
passed by-law number 1999-80 to enter into a contract for the provision of police
services with the Ontario Provincial Police;
AND WHEREAS Council deems it advisable to amend the agreement forming
part of this by-law;
AND WHEREAS the Police Services Act and Regulation defines the minimum
standards of adequate and, effective policing services the Municipality must
provide for its citizens.
NOW THEREFORE the Council for The Municipality of Kincardine ENACTS as
follows:
1. The Council for the Corporation of the Municipality of Kincardine ,enter into
an Agreement to Amend the existing policing services agreement with
respect to the provision of adequate and effective policing services under
Section 10 of the Police Services Act, RSO 1990, c. P.15, such
Addendum attached hereto as Schedule "A".
The Mayor and Cler1< be authorized to sign on behalf of the Corporation of
the Municipality of Kincardine the Addendum to the Agreement with the
Solicitor General which is attached to this by-law and to affIX the
Corporate Seal.
3. That this by-law shall come into full force and effect upon its final passage.

4. That this by-law may be cited as the "OPP, Police Services Agreement
Amendment, By-law".

WHEREAS:
The Police Services Act and Regulation defines the minimum standards of adequate and effective
policing services the Municipality must provide for its citizens and;
The Municipality discharged this duty by entering into a contract with the a.p.p, to provide such
services and;
Pursuant to s. 10 Police Services Act the Municipality established a Police Services Board to
discharge certain responsibilities relating to the provision of Policing Services by the O.P.P.
pursuant to this contract;
THEREFORE: The Parties Agree that;
The O,P.P. shall undertake and be responsible for ensuring that all mandatory standards ofadequate
and effective police services as required by Ontario Regulation 3/99 are completed and in place
within the legislated time ftarne and;
The Police Services Board shall be provided with sufficient documentation, as agreed upon between
the board and the O.P.P., to allow the board to evaluate the services and satisfy itself that adequate
and effective standards and policies are in place;
AND FURTHER:
It shall be the responsibility of the Police Services Board to monitor the delivery of policing
services to ensure that the provisions of Ontario Regulation 3/99 are satisfied on an ongoing basis,
