THE CORPORATION OF THE TOWNSHIP OF KlNCARDINE-BRUCE- TIVERTON
BY-LAW
BY-LAW NO. 1999 - 72
BEING A BYLAW TO AMEND BY-LAW NO. 82-08, BEING THE
COMPREHENSIVE ZONING BY-LAW FOR THE TOWNSHIP OF
KINCARDINE (PART LOTS 18, 19 & 20, CONCESSION 2, S.D.R.,
TOWNSHIP OF KINCARDNE-BRUCE- TIVERTON, FORMER
TOWNSHIP OF KINCARDINE)
WHEREAS Section 34 of the Planning Act, R.S.O. 1990, Chapter 13, authorizes
the councils of municipalities to enact and amend zoning by-laws which comply
with an approved official plan;
AND WHEREAS the Council of The Corporation of the Township of Kincardine
has enacted By-Law No. 1982-08, a zoning by-law enacted under Section 34 of
the said Planning Act;
AND WHEREAS the Council of the Corporation of the Township of Kincardine-
Bruce- Tiverton desires to amend By-Law 1982-08;
NOW THEREFORE the Council for The Corporation of the Township of
Kincardine-Bruce- Tiverton ENACTS as follows:
1. By-Law No. 82-08, as amended, being the Comprehensive Zoning By-Law
for the Township of Kincardine, as amended, is hereby further amended
by adding the following subsection to Section 9.3 thereof:
"9.3.39 a) Notwithstanding their 'A l' zoning designation, those lands
designated as 'A 1-a' on Schedule 'A' to this By-law, may be
used for non-farm residential purposes, in compliance with
the A 1 zone provisions contained in this by-law, excepting
however, that:
i) the minimum lot area shall be 2.1 hectares (5.2
acres) ;
ii) the minimum lot frontage shall be 103 metres (350
feet);
iii) "lot area" shall be defined as the total horizontal
distance within the lot lines of a lot; and,
iv) Section 6.3(a), Watercourse Setback, shall not apply
to the lands.
9.3.39 b) Notwithstanding their 'A1' zoning designation, those lands
delineated as 'A 1-b' on Schedule 'A' to this By-law shall be
used for agricultural purposes in accordance with the 'A l' zone
provisions contained in this by-law, excepting however that:
i)

residential structures shall be prohibited;
Section 6.3(a), Watercourse Setback, shall not apply
to the lands.

Schedule 'A'to By-law No. 82-08, as amended, is hereby further amended
by changing thereon from 'A l' and 'EP' to 'A 1-a', 'A 1-b' and "EP' the
zoning designation of Part of Lots 18, 19, and 20, Concession 2, S.D.R.,
Township of Kincardine-Bruce.Tiverton (former Township of Kincardine),
as shown outlined in the heaviest broken line on the attached Schedule
'A'.
3. This By-Law takes effect from the date of passage by Council and comes
into force and effect pursuant to the provisions of the Planning Act, 1990.
4. This by-law may be cited as the "Amendment to Comprehensive Zoning
By-Law 82-08 By-Law (Part lots 18, 19 & 20, Concession 2, S.D.R.,
former Township of Kincardine).
READ a FIRST, SECOND and THIRD time and FINALLY PASSED this
30th day of June, 1999.
