THE CORPORATION OF THE TOWNSHIP OF KINCARDlNE-BRUCE-TIVERTON BY-LAW BY-LAW NO. 1999 - 71 BEING A BYLAW TO AMEND BY-LAW NO. 82-08, BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE TOWNSHIP OF KINCARDINE (PART OF LOT 30, CONCESSION A, LOT 3 PLAN 491, TOWNSHIP OF KINCARDINE-BRUCE-TIVERTON, FORMER TOWNSHIP OF KINCARDINE) WHEREAS Section 34 of the Planning Act, R.S.O. 1990, Chapter 13 authorizes the councils of municipalities to enact and amend zoning by-laws which comply with an approved official plan; AND WHEREAS the Council of The Corporation of the Township of Kincardine has enacted By-Law No. 1982-08, a zoning by-law enacted under Section 34 of the said Planning Act; AND WHEREAS the Council of the Corporation of the Township of Kincardine- Bruce- Tiverton desires to amend By-Law 1982-08; NOW THEREFORE the Council for The Corporation of the Township of Kincardine-Bruce- Tiverton ENACTS as follows: 1. By-Law No. 82-08, as amended, being the Comprehensive Zoning By-Law for the Township of Kincardine, as amended, is hereby further amended by adding the following subsection to Section 32.2 thereof: "32.2.16 Notwithstanding their 'PO' zoning designation, those lands designated as 'PD-13' on Schedule 'A' to this By-law, may be used in residential purposes, in compliance with the R2 zone provisions contained in this by-law, excepting however, that:: 2. i) Section 6.13, Watercourse Setback, shall not apply. Schedule 'A' to By-law No. 82-08, as amended, is hereby further amended by changing thereon from 'PO' and 'OS' to 'PD-13' and 'EH' the zoning designation of Part of Lot 30, Concession A, Lot 3, Plan 491, Township of Kincardine-Bruce-Tiverton (former Township of Kincardine), as shown outlined in the heaviest broken line on the attached Schedule 'A'. 3. This By-Law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning Act, 1990. .. .2/ :-. r. . . This by-law may be cited as the "Amendment to Comprehensive Zoning By-Law 82-08 By-Law (Part of Lot 30, Concession A, Lot 3, Plan 491, former Township of Kincardine).
