NO. 1999 - 46
A TEMPORARY USE BYLAW TO AMEND BY-LAW NO. 82-08, AS
AMENDED, BEING THE COMPREHENSIVE ZONING BY-LAW OF THE
TOWNSHIP OF KINCARDINE AS IT APPLIES TO CERTAIN LANDS
RECENTLY ANNEXED BY AND NOW WITHIN THE FORMER TOWN OF
KINCARDINE, NOW THE TOWNSHIP OF KINCARDINE-BRUCE TIVERTON
WHEREAS Section 34 of the Planning Act, R.S.O. 1990, Chapter 13, authorizes the
councils of municipalities to enact and amend zoning by-laws which comply with an
approved official plan;
AND WHEREAS the Council of The Corporation of the Township of Kincardine has
enacted By-law No. 1982-08, a zoning by-law enacted under Section 34 of the said
Planning Act;
AND WHEREAS the Council of the Corporation of the Township of Kincardine-Bruce-
Tiverton desires to amend By-law No. 1982-08;
NOW THEREFORE The Council of the Corporation of the Township of Kincardine-
Bruce- Tiverton pursuant to Section 39 of the Planning Act, 1990, ENACTS as follows:
1.
By-Law No. 82-08, as amended, being the Comprehensive Zoning By-Law for
the Corporation of the Township of Kincardine, as it applies to lands within the
former Town of Kincardine, now the Township of Kincardine-Bruce-Tiverton, is
hereby amended by adding the following subsection to Section 10.1 thereof:
10.1.9
Notwithstanding their 'A2' zoning designation, those lands
delineated as 'A2-9' on Schedule 'A' to this By-law may be used
for restrictive agricultural purposes, in accordance with the 'A2'
zoning provisions, excepting however that:
(i) outdoor recreation events limited to automotive and
recreation vehicle racing/mud bogging and music festivals
shall be permitted;
(ii) accessory uses to a permitted outdoor recreation event
shall include parking, camping, and concession stands;
(iii) all site alterations shall be rehabilitated to their natural
state to the satisfaction of the municipality and the
Saugeen Valley Conservation Authority;
(iv) no sediment from the operation of a permitted use
identified in clause (i) shall be allowed to enter the
penetangore River or any of its tributaries; and,

(v)
outdoor recreation events and associated accessory uses
shall be permitted for a period not to exceed three (3)
years from the date of the passing of this by-law.
2. By-Law No. 82-08, as amended, being the Comprehensive Zoning By-Law for
the Corporation of the Township of Kincardine, as it applies to lands within the
former Town of Kincardine, now the Township of Kincardine-Bruce-Tiverton, is
hereby amended by adding the following subsection to Section 31.4 thereof:
31.4.2
Notwithstanding their 'EP' zoning designation, those lands
delineated as 'EP-2' on Schedule 'A' to this By-Law may be used
for environmental protection purposes, in accordance with the
'EP' zoning provisions, excepting however that:
(i) outdoor recreation events limited to automotive and
recreation vehicle racing/mud bogging and music festivals
shall be permitted;
(ii) no buildings, structures or camping, associated with an
outdoor recreation event shall be permitted;
(iii) all site alterations shall be rehabilitated to their natural
state to the satisfaction of the municipality and the
Saugeen Valley Conservation Authority;
(iv) no sediment from the operation of a permitted use
identified in clause (i) shall be allowed to enter the
Penetangore River or any of its tributaries; and,
(v) outdoor recreation events and associated accessory uses
shall be permitted for a period not to exceed three (3)
years from the date of the passing of this by-law.

Schedule 'A' to By-law No. 11-82, as amended, is hereby further amended by
changing thereon from 'A2 - Restrictive Agriculture' and 'EP - Environmental
Protection' to 'A2-9 Restrictive Agriculture Special' and 'EP-2 - Environmental
Protection Special' those lands described as Part Lots 1 and 2, Concession 2,
S.D.R, in the former Town of Kincardine, now the Township of Kincardine-
Bruce-Tiverton, which are outlined in the heaviest black broken line of the
attached Schedule 'A'.
4. All development permitted under Sections 10.1. 9(i) and 31.4.2(i) of this By-
Law, on lands described as Part Lots 1 and 2, Concession 2, S.D.R, former
Town of Kincardine, now the Township of Kincardine-Bruce-Tiverton, shall take
place in accordance with the Schedule 'B' attached to and forming part of this
By-Law.
5. This By-law takes effect from the date of passage by Council and comes into
force and effect pursuant to the provisions of the Planning Act, 1990.
6. This By-Law shall be cited as the Temporary Use to Amend the Township of
Kincardine Comprehensive Zoning By-Law No. 82-08 (Part Lots 1 & 2, Conc. 2,
S.D.R, former Town of Kincardine).
