THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
NO. 2002 -154
BEING A BY-LAW TO PROVIDE FOR THE CONTINUATION OF
ONE-THIRD OF THE REMUNERATION PAID TO ELECTED
MEMBERS OF COUNCIL AS EXPENSES INCIDENT TO THE
DISCHARGE OF THEIR DUTIES AFTER DECEMBER 31 2002
WHEREAS Section 255(2) of the Municipal Act, R.S.O. 1990, chapter MA5, as
amended, authorizes councils of municipalities to pass a resolution before
January 1, 2003 stating its intention that one-third of the remuneration paid to
elected members of the council and its local boards shall continue as expenses
incident to the discharge of their duties as members of the council or local board;
AND WHEREAS Section 283(5) of Bill 111 An Act to Revise the Municipal Act
and to Amend or Repeal other Acts in relation to Municipalities, 2001, Chapter
25, as amended, provides that where a resolution of a municipality under
subsection 255(2) of the old Act is not revoked before January 1, 2003, one-third
of the remuneration paid to the elected members of the council and its local
boards is deemed as expenses incident to the discharge of their duties as
members of the councilor local board;
AND WHEREAS Section 283(7) of Bill 111 referred to above requires council to
review a by-law under subsection (5) at least once during the three-year period
corresponding to the term of office of its members after a regular election,
NOW THEREFORE the Council for the Municipality of Kincardine hereby enacts
as follows:
1. THAT one-third of the remuneration paid to elected members of the council
and its local boards shall continue as expenses incident to the discharge of
their duties as members of the councilor local board.
2. THAT this by-law shall be reviewed at least once during the three year period
corresponding to the term of office of its members after a regular election.
3. This by-law shall come into full force and effect upon its final passage.
4. This by-law may be cited as the "Councilor One-third Remuneration As
Expenses Continuation By-law".
