HomeMy WebLinkAbout02 160 lt 58 conc. a robin/nor e e e e THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE NO. 2002 -160 A BY-LAW TO AUTHORIZE THE GRANTING OF RIGHTS OF WAY OVER PARTS OF LOT 58, CONCESSION A MUNICIPALITY OF KINCARDINE (FORMER TOWNSHIP OF KINCARDINE) WHEREAS the Council for The Municipality of Kincardine has entered into Agreements of Purchase and Sale for property legally described as Part of Lot 58, Concession A, Township of Kincardine, (now Municipality of Kincardine), County of Bruce designated as Part 6 on Reference Plan 3R-3036 and Parts 1, 2,3 and 4 on Reference Plan 3R-7648; and Part of Lot 58, Concession A, Township of Kincardine (now Municipality of Kincardine), County of Bruce designated as Part 7 on Reference Plan 3R-3036 Subject to Rights of Way over the said Parts 7 on Reference Plan 3R-3036; AND WHEREAS the Municipality of Kincardine has deemed it advisable that as part of the consideration for the acquisition of these properties that a right of way be granted over those lands known as part of Lot 58, Concession A, Township of Kincardine (now Municipality of Kincardine) County of Bruce designated as Parts 6 and 7 on Reference Plan 3R-3036 and Parts 1, 2, 3 and 4 on Reference Plan 3R-6748 to John Ferguson Robinson, Murray Vern Norman, Daniel Vern Norman and Jessie Marie Anastasia Robinson for the benefit of their lands being part of the said lot 58, being more particularly described in Schedule "A" attached hereto; AND FURTHER That The Municipality of Kincardine has deemed it advisable that as part of the consideration for the acquisition of these properties that a right of way be granted over those lands known as Parts of Lot 58, Concession A, Township of Kincardine (now Municipality of Kincardine) County of Bruce designated as Parts 6 and 7 on Reference Plan 3R-3036 and Parts 1, 2, 3 and 4 on Reference Plan 3R-6748 to Jessie Marie Anastasia Robinson, Murray Vern Norman and Daniel Vern Norman for the benefit of their lands being part of the said lot 58, being more particularly described in Schedule "B" attached hereto; NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the Corporation of the Municipality of Kincardine grant a right of way to John Ferguson Robinson, Murray Vem Norman, Daniel Vem Norman and Jessie Marie Anastasia Robinson over that parcel of property known as parts of Lot 58, Concession A, Township of Kincardine (now Municipality of Kincardine) County of Bruce designated as Parts 6 and 7 on Reference Plan 3R-3036 and Parts 1, 2, 3 and 4 on Reference Plan 3R-7648; 2. That the Corporation of the Municipality of Kincardine grant a right of way to Jessie Marie Anastasia Robinson, Murray Vern Norman and Daniel Vern Norman over that parcel of property known as parts of lot 58, Concession A, Township of Kincardine (now Municipality of Kincardine), County of Bruce designated as Parts 6 and 7 on Reference Plan 3R-3036 and Parts 1, 2, 3 and 4 on Reference Plan 3R-7648; 3. That the Mayor and CAO be authorized to execute, on behalf of The Corporation of the Municipality of Kincardine, any documents required to transfer this right of way and to affix the corporate seal as and when required; 4. PREMISING that the Northerly limit of said lot has a bearing of North 60 degrees 21 minutes and 10 seconds west and relating all bearings herein thereto. COMMENCING at the Southeasterly angle of said lot; THENCE North 29 degrees 28 minutes 35 seconds East along the Easterly limit of said lot, a distance of 652.92 feet to the Northeasterly angle of said lot; THENCE North 60 degrees 21 minutes 10 seconds West along the Northerly limit of said lot 58, a distance of 7795.50 feet to the Northeasterly angle of Part 1 according to Reference Plan filed in the Bruce county Registry Office as 3R-3036; THENCE South 17 degrees 08 minutes and 15 seconds West along the Easterly limits of Parts 1, 2, 4 and 7 according to the said Reference Plan 3R-3036 a distance of 365.75 feet to the southeasterly corner of the said Part 7; e THENCE South 70 degrees 56 minutes 30 seconds East a distance of 10.0 feet; THENCE South 62 degrees 14 minutes 50 seconds East a distance of 164.35 feet; THENCE South 75 degrees 16 minutes 10 seconds East a distance of 485.92 feet; THENCE South 60 degrees 21 minutes 10 seconds East a distance of 625.0 feet; THENCE South 36 degrees 10 minutes and 40 seconds East a distance of 161.0 feet; THENCE South 2 degrees 27 minutes 50 seconds West a distance of 280.71 feet to intersection with a line drawn on a bearing of North 28 degrees 59 minutes 50 seconds East from a point on the Southerly Limit of said lot distant 6209.50 feet measured on a bearing of North 66 degrees 45 minutes 10 seconds West from the Northeasterly angle of said lot; e THENCE South 28 degrees 59 minutes 50 seconds West along the last mentioned line a distance of 106.12 feet to a point on said line distant 45.75 feet measured North 28 degrees 59 minutes 50 seconds East thereon from the Southerly limit of said lot; THENCE South 61 degrees 00 minutes and 10 seconds East and parallel with the said Southerly limit a distance of 651.29 feet; THENCE South 23 degrees 26 minutes 00 seconds East a distance of 75.03 feet to the said southerly limit; THENCE South 61 degrees 00 minutes 10 seconds East along the said Southerly limit to the point of commencement. Save and except Part 2 according to Registered Plan Number 1055 filed in the Bruce County Registry Office.
