I I WHEREAS the Council for The Municipality of Kincardine deerrjs it advisable to enter into a Lease Agreement with Skid School Inc.; I I AND WHEREAS this lease agreement provides Skid SChOOllnc.lto rent a portion of the premises that are part of the land and building known mU~iCiPallY as 1475 Concession 5, Municipality of Kincardine and described as Co cession A, Part Lot 29 and 30, in the Municipality of Kincardine (former Townsh p of Kincardine, for the term of 5 (five) years, to begin July 3, 2002 and to end Ju e 30, 2007; I NOW THEREFORE the Council for The Corporation of thel Municipality of Kincardine ENACTS as follows: I 1. That the Corporation of the Municipality of Kincardine enter i~to an agreement with Skid School Inc. 2. That the Mayor and CAO be authorized to sign, on behalf of The Corporation of the Municipality of Kincardine, the Lease Agreement with Skid School Inc. attached to this by-law and to affix the corporate seal as and hen required. 3. This By-law shall come into full force and effect upon its final passage. I 4. This By-law may be cited as the "Skid School Inc. Lease Agrtement, By-law". THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE hereinafter called the "Municipality" of the First Part. -and- SKID SCHOOL INC. Hereinafter called the " Lessee" of the Second Part. WHEREAS the Municipality owns the Kincardine Municipal Administrative Centre, located at 1475 Concession 5, R.R. 5, Kincardine, Ontario; AND WHEREAS the Lessee requires a location from which to operate a safe driving school; AND WHEREAS the lessee has entered into a Site Plan Control Agreement with the Municipality; AND WHEREAS this is intended to be an agreement for a period of five years (July 3, 2002 to June 30, 2007); NOW THEREFORE THIS AGREEMENT WITNESSETH THAT in consideration of other good and valuable consideration and the sum of TWO DOLLARS ($2.00) of lawful money of Canada, now paid by each of the two parties hereto, (the receipt whereof is hereby acknowledged) the parties hereto covenant, promise and agree with each other as follows: 1.0 LIST OF SCH.EDVLE~ ATTACHED 1.1 The following schedule is attached and forms part of this agreement: Schedule "A" - Site Plan Control map to outline areas under Site Plan Control. 2.0 Uability Insurance 2.1 Prior to the operation of any activity the Lessee must furnish to the Municipality the following documentation: i. A general liability insurance policy with a minimum of $1,000,000.00 (one million dollars), with the municipality named as an additional insured on the policy and hold the municipality harmless in any loss; ii. Proof of automobile liability insurance, with a minimum limit of $1,000,000.00 (one million dollars); iii. Annual verification of policies must be done by January 1 st of each year prior to any activity. iv. Cancellation of any insurance policy or the absence of verification win automatically cancel this agreement. . L· . . .! d Page 2 of 3 Skid School Rental Agreement 3.0 MunlclDal Aaents 3.1 The Municipality's CAO shall act as the agent for the municipality in the administrative matters contained in this agreement. In addition, the Municipality's Public Works Manager shall act in any building or grounds related matters contained in this agreement. 4.0 Rental Schedule 4.1 The Lessee agrees to the following rental rates: · Public hall: $60.00 per day (8.30 am to 12.30 pm) (includes use of tarmac all day) or, $1,000.00 monthly. · Tarmac only: $40.00 per day or $ 600.00 monthly. 4.2 The above rates do not include GST. 6.0 SàE.,NERAI,. Either party may terminate this agreement with a sixty (60) day notice period being utilized. 6.1 . 6.2 6.3 6.4 6.5 . . The term of this agreement is July 1, 2002 to June 30, 2007. All exterior tanks must be painted in order to blend into the landscape. Monthly schedules shall be provided one month in advance. The Lessee acknowledges that bookings are on a first come, first served basis and agrees to makes changes to the schedule if unexpected events arise.
