BY-LAW NO. 2002 - 04 WHEREAS Section 370 of the Municipal Act, Chapter M 45, R.S.O. 1990 provides that the Council of a local municipality may, in 2002, fore adoption of the estimates for the year, pass a by-law to levy on the whole f the assessment for real property according to the last revised assessment II, a sum not to exceed that which would be produced by applying 50 percent f the total amount of taxes for municipal and school purposes levied on an an ualized basis on each property class for the year 2001,' I I AND WHEREAS Sections 399 and 419 provide for the imposinp of a penalty and interest respectively on taxes due but not yet paid, ' NOW THEREFORE the Council of the Corporation of thþ Municipality of Kincardine ENACTS as follows: I 1) An interim levy which will produce an amount not xceeding 50% of the total amount of taxes for municipal and scho I purposes levied on each property class for the year 2001. 2) That the dates for payment of taxes under this y-Iaw shall be as follows: Due date of 1st installment................................. March 151 ¡ Due date of 2nd installment.................................. June 3rd That a percentage charge of 1.25 per cent 11.25%) shall be imposed as a penalty for non-payment of taxe of any class or installment thereof on the first day of default and on the first day of each calendar month thereafter in which defau t continues up to and including December of each year. ! On all other taxes in default on January 1st, 200 , interest shall be added at the rate of 1.25 per cent (1.25%) per month or fraction thereof. 3) 4) 5) Penalties and interest added on all taxes, includ ng the interim tax levy, in defaun shall become due and paya Ie and shall be collected forthwith as if the same had originally een imposed and formed part of such interim levy. .../2 - e e e 2002 Interim Taxation By-Law By-Law No. 2002 - 04 Page 2 of 2 6) That the Treasurer, not later than 21 days prior to he date that the first installment is due, shall give to the person axed, a printed notice specifying the amount of the taxes payable y delivering the notice or causing it to be delivered to or for th t person at the person's residence or place of business or upon the premises in respect of which the taxes are payable. ¡ That the notice shall include the due date for eac~ installment and the particulars of the penalties imposed for late pa~ent. I That the Treasurer be and is hereby authorize to accept part payment from time to time on account of any taxe due and to give receipt for such part payment, provided that ac eptance of any such part payment does not affect the collection 0 any percentage charge imposed and collectable, under section 39 ,subsection 3 of the Municipal Act, in respect of non-payment of jny taxes or any class of taxes or of any installment thereof. 7) 8) That taxes shall be payable to the Corporation of t e Municipality of Kincardine and can be paid to the Treasurer t the Municipal offices, by pre-authorized payment, at any local fi ancial institution in the Municipality of Kincardine which accepts sue payments or in any other manner or location approved by Council. 9) That this by-law shall come into full force upon its nal passage and may be cited as the "2002 Interim Taxation By-law· ¡ !
