THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2000 - 93 BEING A BYLAW TO AMEND ZONING BY-LAW NO. 82-08, BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE TOWNSHIP OF KINCARDINE, (FRITZ - LOT 17 AND LOT 18, CONCESSION 4), MUNICIPALITY OF KINCARDINE, (FORMER TOWNSHIP OF KINCARDINE) WHEREAS Section 34 of the Planning Act, R.S.O. 1990, Chapter 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws which comply with an approved official plan; AND WHEREAS the Council of the Corporation of the Municipality of Kincardine has enacted By-law 82-08, a zoning by-law enacted under Section 34 of the said Planning Act; AND WHEREAS the Council of the Corporation of the Municipality of Kincardine desires to amend By-law 82-08; NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine ENACTS as follows: 1. Schedule "A" to By-law No. 82-08 as amended, is hereby further amended by changing therein the zoning designation of Lot 17 and Lot 18, Concession 4 (former Township of Kincardine) from 'A1' to 'A1-2000-93a', and 'A 1-2000-93b' which are outlined on the attached Schedule 'A'. 2. By-Law No. 82-08, as amended, being the Comprehensive Zoning By-Law for the Township of Kincardine, is hereby further amended by adding the following paragraphs to Section 9.3 thereof: Notwithstanding their 'A l' zoning designation, the lands delineated as 'A 1-2000-93a' on Schedule 'A' to this By-law may be used for non-farm residential purposes in accordance with the 'A l' zone provisions contained in this by-law, excepting however that: (i) the 'minimum lot area' shall be 1.0 ha (2.5 acres) (ii) no intensive livestock operations (over 150 livestock units or 1.5 livestock units per tillable acre) shall be permitted (iii) all future development must comply with the requirements of the by-law. · · · · By-Law 2000 - 93 Amendment to By-Law 82-08 (Lot 17 and Lot 18, Concession 4) Page 2 of 2 Notwithstanding their 'A l' zoning designation, the lands delineated as 'A 1-2000-93b' on Schedule lA' to this By-law shall be used in accordance with the 'General Agriculture-A l' zone provisions contained in this By-law excepting however that: (i) no residential buildings or residential structures shall be permitted (ii) no intensive livestock operations (over 150 livestock units or 1.5 livestock units per tillable acre) shall be permitted. 3. This By-law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning Act, R.S.O. 1990. 4.
