THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2006 -100
BEING A BY..LAW TO ACCEPT A TENDER TO PURCHASE HEALTH CLUB
EQUIPMENT FOR THE DAVIDSON CENTRE FOR KINCARDINE AND
DISTRICT
(PPL Fitness)
WHEREAS the Municipal Act, 2001, 5.0. 2001, c. 25 Section 11 (2) provides that
lower-tier municipalities may pass by-laws within the sphere of jurisdiction of
culture, parks, recreation and heritage;
AND WHEREAS the Municipal Act, 2001, 5.0. 2001, c. 25 Sections 8 and 9 (1)
provides municipalities with powers of a natural person to enable them to govern
their affairs as they consider appropriate and to enhance their ability to respond to
municipal issues;
AND WHEREAS the Council for The Corporation of the Municipality of Kincardine
deems it necessary to purchase health club equipment for the gym at The
Davidson Centre for Kincardine and District;
AND WHEREAS the Council for The Corporation of the Municipality of Kincardine
deems it expedient to accept a tender to purchase health club equipment from
PPL Fitness in the amount of $36,585.00;
AND WHEREAS the Council for The Corporation if the Municipality of Kincardine
grants permission to purchase additional pieces of health club equipment from
PPL Fitness with the understanding that all purchases stay within the allotted
$50,000.00 budget.
NOW THEREFORE the Council for The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That the tender of PPL Fitness for the purchase of health club equipment
for the gym at The Davidson Centre for Kincardine and District in the
amount of $36,585.00, including taxes, be hereby accepted.
2. That additional pieces of health club equipment may be purchased from
PPL Fitness subject to the allotted $50,000.00 budget.
3. That the Mayor and CAD be hereby authorized to sign, on behalf of the
Council for The Corporation of the Municipality of Kincardine any contracts
and other documents required to authorize such purchase.
4.
This by-law shall come into full force and effect upon its final passage.

5. This by-law may be cited as the "Davidson Centre Health Club Equipment
Tender Acceptance By-law".
