THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
No. 2006 - 097
BEING A BY-LAW TO AMEND ZONING BY-LAW NO. 76-13,
BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE
FORMER TOWNSHIP OF BRUCE
Enbridge Ontario Wind Power LP,
Lot 9, Concession 7, Municipality of Kincardine (former Township of Bruce)
The Council of the Corporation of the Municipality of Kincardine pursuant to Section 39
of the Planning Act, 1990, ENACTS as follows:
1. Schedule 'A' to By-law No. 76-13, as amended, is hereby further amended by
changing thereon from 'A' to 'A-63' and 'H' the zoning designation of those lands
described as Lot 9, Concession 7, Municipality of Kincardine (former Township of
Bruce) as outlined on Schedule 'A', attached to and forming part of this By-law.
2. By-law No. 76-13, as amended, being the Zoning By-law for the former Township
of Bruce, is hereby further amended by adding the following subsection to
Section 5.0 thereof:
5.17 Notwithstanding their 'A' zoning designation, those lands described as Lot
9, Concession 7, Municipality of Kincardine (former Township of Bruce)
and delineated as 'A-63' on Schedule 'A' to this By-law shall be used in
compliance with the 'A' Zone provisions contained in this By-law,
excepting, however, that:
(i)
A 'Lay Down Area' shall be a permitted use. For the
purposes of this By-law, the term 'Lay Down Area'
shall mean lands used for the temporary storage of
wind turbines, tower sections, nacelles, and blades.
Lands may also be used for the temporary storage of
heavy equipment and building materials, and may
include a 'construction trailer'.
(ii) The Council of the Corporation of the Municipality of
Kincardine may require the owner of the subject lands
or any other persons to enter into an Agreement with
the Municipality;
(iii) The period of time for which this By-law shall be in
effect, shall not exceed three (3) ~ears from the day of
the passing of the by-law (i.e. 14t day of June 2009)
or sooner should the owners or any other persons no
longer require the temporary use of the lands for the
purpose of a 'Lay Down Area'.
(iv) The Council of the Corporation of the Municipality of
Kincardine may by by-law grant further periods of not
more than three (3) years each during which the
temporary use is authorized.

3. This By-Law takes effect from the date of passage by Council subject to the .
provisions of the Planning Act, R.S.O. 1990, as amended.
4. That this by-law may be sited as "Amendment to the Comprehensive Zoning 76-
13, [Enbridge Ontario Wind Power LP, Lot 9 Concession 7, Municipality of
Kincardine [former Township of Bruce)], By-law"
Read a FIRST, SECOND and a THIRD time and FINALLY PASSED this 14th day of
June 2006.
