TIIE CORPORATION OF TIIE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2000·21
BEING A BY-LAW TO AMEND BY-LAW NO. 82-08,
BEING THE COMPREHENSIVE ZONING BY-LAW FOR
THE (FORMER) TOWNSHIP OF KINCARDINE - (TURCOTTE PART LOT 28,
CONCESSION "A" 43 SANDPIPER LANE) MUNICIPALITY OF KINCARDINE
(FORMER TOWNSHIP OF KINCARDINE)
WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes
the Councils of Municipalities to enact and amend zoning by-laws which comply
with an approved official plan;
WHEREAS the Council of the Corporation of the Township of Kincardine has
enacted By-law 82-08, a zoning by-law enacted under Section 34 of the said
Planning Act;
AND WHEREAS the Council of the Corporation of the Municipality of Kincardine
desires to amend By-law 82-08;
NOW THEREFORE the Council for The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. By-Law No. 82-08, as amended, being the Comprehensive Zoning By-Law
for the Township of Kincardine, as amended, is hereby further amended
by adding the following subsection to Section 32.2 thereof:
32.2.18 Notwithstanding their 'PD' zoning designation, those lands
. designated as 'PD-2' on Schedule 'A' to this By-law, may be
used in residential purposes, in compliance with the R2 zone
provisions contained in this by-law, excepting however, that:
(a) Section 6.5, frontage on a public street, shall not apply.
2. Schedule 'A' to By-law No. 82-08, as amended, is hereby further amended
by changing thereon from 'PD' to 'PD-2 and EP- Environmental Protection'
the zoning designation of Part of Lot 28, Concession A, Municipality of
Kincardine (former Township of Kincardine), as shown outlined in the
heaviest broken line on the attached Schedule 'A'.
3. This By-Law takes effect from the date of passage by Council and comes
into force and effect pursuant to the provisions of the Planning Act, 1990.
4. This by-law may be cited as the "Amendment to Comprehensive Zoning
By-Law 82-08 By-law (Part of Lot 28, Concession A, former Township of
Kincardine)".
READ a FIRST, SECOND and THIRD time and DEEMED TO BE PASSED this
9th day of February, 2000.
