THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2006 - 082
BEING A BY-LAW TO ACCEPT A TENDER TO PURCHASE A 4.2 METRE (14') DUAL-
PURPOSE DUMP BODY AND SANDER, FRONT ONE-WAY PLOW AND CLOSED
TOWER HIGH LEVELLING WING
(Viking Cives Ltd.)
WHEREAS Section 44 of the Municipal Act, 2001, S.O. 2001, c. 25 provides that a
municipality that has jurisdiction over a highway or bridge shall keep it in a state of repair
that is reasonable in the circumstances;
AND WHEREAS pursuant to the said Municipal Act, Sections 8 and 9 (1) provide
municipalities with the powers of a natural person to enable them to govern their affairs
as they consider appropriate under this or any other Act and to enhance their ability to
respond to municipal issues;
AND WHEREAS it has been determined that the Municipality of Kincardine Public Works
Department requires a 4.2 metre (14 foot) Dual-Purpose Dump Body and Sander, Front
One-Way Plow and Closed Tower High Levelling Wing to assist in the maintenance of the
municipality's highways;
AND WHEREAS the Council for The Corporation of the Municipality of Kincardine deems
it expedient to accept a tender to purchase a 4.2 metre (14 foot) Dual-Purpose Dump
Body and Sander, Front One-Way Plow and Closed Tower High Levelling Wing from
Viking Cives Ltd;
NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine
ENACTS as follows:
1.
That the tender of Viking Cives Ltd. in the amount of $82,219.25, including taxes,
for the purchase of a Dual-purpose dump body and sander, front one-way plow
and closed tower high levelling wing, be hereby accepted.
2. That the Mayor and CAO be hereby authorized to sign, on behalf of the Council
for The Corporation of the Municipality of Kincardine any contracts and other
documents required to authorize the purchase.
3. . This by-law shall come into full force and effect upon its final passage.
4. This by-law may be cited as the "Dual Purpose Dump Body and Sander, Front
Way Plow and Closed Tower High Levelling Wing (Viking Cives Ltd.) Tender
Acceptance, By-law".
READ a FIRST, SECOND and THIRD TIME and FINALLY PASSED this 17th day of May,
2006.
