THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
No. 2000 -117
BEING A BYLAW TO AMEND
THE NUTRIENT MANAGEMENT BY-LAW
WHEREAS the Council of The Corporation of the Township of Kincardine Bruce
Tiverton, now The Municipality of Kincardine, enacted By-law No. 1999-73, as
amended, on July 7, 1999, to regulate manure pits and livestock facilities in the
Municipality;
AND WHEREAS on the date of passing By-law 1999-73, as amended, the term
"Intensive Livestock" was commonly defined as 150 animal units or greater;
AND WHEREAS the Ministry of Agriculture Food and Rural Affairs and various
Agricultural Groups have since commenced a consultation process to define
"Intensive Agriculture" and provide legislation regulating such agricultural
operations;
AND WHEREAS during OMAFRA's consultation process the agricultural experts
have discussed a more scientific method of defining "Intensive Agriculture" based
on the amount and type of nutrients produced by the various types of farm
operations;
AND WHEREAS The Municipality of Kincardine is concerned that the Provincial
Govemment has not adopted a clear definition of "Intensive Agriculture" and has
not provided municipalities with the necessary legislation to administer, monitor
or enforce intensive livestock operations to effectively safeguard the municipality
from environmental impacts and concems;
AND WHEREAS The Municipality of Kincardine deems it expedient to amend
By-law 1999-73 for the purpose of reducing the 150 animal unit threshold to 50
animal units to ensure the regulatory legislation and environmental safeguards
are in effect for agricultural operations which may meet or exceed the "Intensive
Agriculture" definition which will eventually be determined by OMAFRA;
NOW THEREFORE the Council for The Municipality of Kincardine ENACTS as
follows:
1. That the references in By-law 1999-73 in Clause 2.2; Clause 5.4.2 and
Clause 5.4.4 which read "and/or 100 animal units", and which was
changed by By-law 1999-112 to read "or 150 animal units", be further
amended to read "or 50 animal units".
2.
That By-law #1999-112 be repealed.
3. That this by-law shall come into full force and effect on it final passing.

This by-law may be cited as the "Nutrient Management Amendment
October 2000, By-law."
READ a FIRST, SECOND, and THIRD time and DEEMED TO BE PASSED
this 4th day of October, 2000.
