BY-LAW
NO. 2000 -18
A BYLAW TO REMOVE CERTAIN LANDS
FROM PART LOT CONTROL

WHEREAS Subsection SO(7) of the planning Act, R.S.O. 1990 permits Council of
a local municipality to exempt lands within a plan of subdivision from the
requirements of Subsection S of Section SO of the said act;
AND WHEREAS the owners of the land have made application to the
Municipality of Kincardine to remove part lot control from certain lands they own
in the Municipality of Kincardine (former Town of Kincardine).
NOW THEREFORE the Council for The Corporation of the Municipality of
Kincardine ENACTS as follows:
1. That Subsection S of Section SO of the Planning Act shall not apply to the
parts of the plan of subdivision described as follows:
i) Lots 8 and 39, of Plan M-S9
ii) Lots 120, 122, 123, 124, 126 of Plan M-3S

This by-law shall come into full force and effect upon the Approval of the
County of Bruce.
Upon approval of the By-law by the County of Bruce, the Clerk of the
Municipality of Kincardine is hereby instructed and authorized to register
this By-law in the Land Registry Office for Bruce County.
This By-law shall expire within 3 years from the date of passage of the By-
law.
S. This by-law may be cited as the ·Part Lot Control Exemption By-law for
Part of Plans M-S9 and M-3S".
READ a FIRST, SECOND and THIRD time and DEEMED TO BE PASSED this
9th day of February, 2000.
