HomeMy WebLinkAbout00 086 Amend No. 82-08 NotFarms . . e e THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2000 - 86 BEING A BY-LAW TO AMEND BY-LAW NO. 82-08, BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE (FORMER) TOWNSHIP OF KINCARDINE (NOTT FARMS- PART LOT 4, LOT 5, CONCESSION 10) MUNICIPALITY OF KINCARDINE WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws which comply with an approved official plan; WHEREAS the Council of the Corporation of the Township of Kincardine has enacted By-law 82-08, a zoning by-law enacted under Section 34 of the said Planning Act; AND WHEREAS the Council of the Corporation of the Municipality of Kincardine desires to amend By-law 82-08; NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That Schedule "A" to the Township of Kincardine Zoning By-law No. 82-08, as amended, is hereby further amended by changing therein the zoning designation of Part of Lot 4 and Lot 5, Concession 10 (former Township of Kincardine) from 'A1' to 'A1-2000-86a', 'A1-2000-86b as shown on the Schedule "A" attached hereto. 2. By-law No. 82-08, as amended, being the Comprehensive Zoning By-law for the Township of Kincardine, is hereby further amended by adding the following paragraphs to Section 9.3 thereof: Notwithstanding their 'A1' zoning designation, the lands delineated as 'A1-2000-86a' on Schedule 'A' to this By-law may be used for rural residential purposes in accordance with the 'A l' zone provisions contained in this by-law, excepting however that: (i) the 'minimum lot area' shall be 1.17 ha (2.9 acres) (ii) all future development must comply with the requirements of the by-law (iii) no intensive livestock operations (over 150 livestock units or 1.5 livestock units per tillable acre) shall be permitted. Notwithstanding their 'A1' zoning designation, the lands delineated as 'A1-2000-86b' on Schedule 'A' to this By-law shall be used in accordance with the 'General Agriculture-A l' zone provisions contained in this By-law excepting however that: (i) no residential buildings or residential structures shall be permitted. ...21 By-law 2000-86 Amendment to By-law 82-08 (Part lot 4, lot 5, Concession 10) Page 2 of 2 e 3. This By-law shall come into force and effect on the final passing thereof by the Council of the Municipality of Kincardine, subject to compliance with the provisions of the Planning Act, R.S.O. 1990, as amended. 4. This by-law may be cited as the "Amendment to Comprehensive Zoning By-law 82-08, By-law (Nott Farms - Part Lot 4, Lot 5, Concession 10, former Township of Kincardine)".
