THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2000 - 34
A BYLAW TO AMEND BY-LAW NO. 82-08, AS AMENDED, BEING THE
COMPREHENSIVE ZONING BY-LAW OF THE
TOWNSHIP OF KINCARDINE
WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes
the Councils of Municipalities to enact and amend zoning by-laws which comply
with an approved official plan;
WHEREAS the Council of the Corporation of the Township of Kincardine has
enacted By-law 82-08, a zoning by-law enacted under Section 34 of the said
Planning Act;
AND WHEREAS the Council of the Corporation of the Municipality of Kincardine
desires to amend By-law 82-08;
NOW THEREFORE the Council for The Corporation of the Municipality of
Kincardine ENACTS as follows:
1.
By-law No. 82-08, as amended, being the Comprehensive Zoning By-law
for the Corporation of the Township of Kincardine is hereby amended by
adding the following subsection to Section 5, definitions thereof, and
renumbering the proceeding subsections accordingly:
"AGRICULTURALLY RELATED COMMERCIAUINDUSTRIAL USE"
shall mean a use directly related to agriculture and requiring proximity to
farm operations and includes such uses as animal husbandry services,
produce or grain storage facilities or farm machinery sales and service
outlets.
"LIVESTOCK FACILITIES" shall mean barns, buildings or structures
where animals are housed and shall also include beef feed lots and the
associated manure storage facilities.
"LIVESTOCK HOUSING CAPACITY" shall mean the total maximum
number of livestock that can be accommodate in a livestock facility at any
one time.
"LIVESTOCK UNIT' shall mean the equivalent values for various types of
animals and poultry based upon manure production and production
cycles."

"MULTIPLE RESIDENTIAL" shall mean a residential building or structure
containing three or more dwelling units.
"RECREATION, ACTIVE" shall mean the use of land, water and/or
building for the purpose of organized active leisure activities and shall
include an arena, a golf course and a sports field.
"RECREATION, PASSIVE" shall mean the use of land, and/or water for
the purpose of passive leisure activity and shall include a park, a garden,
a picnic area and the like as well as a play lot with activity equipment for
children.
"RESIDENTIAL, NON-FARM" shall mean a dwelling unit not located on
the same lot as a subject farm.
"RURAL RESIDENTIAL CLUSTER" shall mean four or more adjacent
non-farm residential lots sharing a common boundary. Lots located
directly across the road from one another shall be considered as having a
common boundary.
"TILLABLE HECTARES" shall mean the total area of land including
pasture that can be worked or cultivated."
"URBAN EXPANSION" shall mean the outward expansion of towns,
villages and hamlets for such uses as residential, recreational,
institutional, commercial and industrial.

By-law No. 82-08, as amended, being the Comprehensive Zoning By-law
for the Corporation of the Township of Kincardine, is hereby further
amended by deleting subsection 8.3 (b) in its entirety.

By-law No. 82-08, as amended, being the Comprehensive Zoning By-law
for the Township of Kincardine, is hereby further amended by adding the
following subsection to Section 8 General Provisions for all Agricultural
Zones:
"8.4 MINIMUM DISTANCE SEPARATION
(a) Notwithstanding any other yard or setback provisions of this By-law
to the contrary, no residential, institutional, commercial, industrial or
recreational use, located on a separate lot and permitted in the
Zone in which the lot is situated, shall be erected or altered unless
it complies with the Minimum Distance separation (MDS 1)
calculated using Schedule B to this By-law.
(b) Notwithstanding any other yard setback provisions of this By-law to
the contrary, no livestock facility shall be erected or expanded
unless it complies with the Minimum Distance Separation (MDS 11)
calculated using Schedule C to this By-law."
4. By-law No. 82-08, as amended, being the Comprehensive Zoning By-law
for the Corporation of the Township of Kincardine, is hereby amended by
deleting Section 4.4, Violations and Penalties and replacing it with the
following:
4.4 "VIOLATIONS AND PENALTIES
(a) Every person who contravenes any of the provisions of this
By-law is guilty of an offence and on conviction is liable,
i) on a first conviction to a fine or not more than twenty-
thousand dollars ($20,000); and,

ii) on a subsequent conviction to a fine of not more than ten
thousand dollars ($10,000) for each day or part thereof
upon which the contravention has continued after the
day on which he was first convicted.
(b) Where a corporation contravenes any of the provisions of this
By-law, the maximum penalty that may be imposed is:
i) on a first conviction a fine of not more than fifty thousand
dollars ($50,0000); and,
ii) on a subsequent conviction to a fine or not more than
twenty-five thousand dollars ($25,000) for each day or
part thereof upon which the contravention continued after
the day on which the Corporation was first convicted.
(c) Every such fine shall be recoverable under the Provincial
Offenses Act, all the provisions of which apply, except that
any imprisonment shall be as provided in The Municipal Act."

By-law No. 82-06, as amended, being the Comprehensive Zoning By-law
for the Corporation of the Township of Kincardine, is hereby amended by
deleting Subsection 5.47, Definitions, "Existing" and replacing it with the
following:
5.47 "EXISTING", unless otherwise indicated, means existing on the
date of passing of this By-law. For the purposes of this by-law,
any existing lot which is of a lesser lot area or frontage than that
required by this By-law and which has been increased in lot area
or frontage through consent of the Bruce County Land Division
Committee, shall be deemed to be a 'existing lot'.
6. By-law No. 82-08, as amended, being the Comprehensive Zoning by-law
for the Corporation of the Township of Kincardine, is hereby amended by
deleting Subsection 5.113, Definitions, "Sewage Disposal System" and
replacing it with the following:
"5.113 "SEWAGE DISPOSAL SYSTEM" shall mean any class of
sewage works, with a designed capacity of less than 10,000 litres
per day, as defined in the Building Code Act and the Building
Code."

By-law No. 82-08, as amended, being the Comprehensive Zoning By-law
for the Corporation of the Township of Kincardine, is hereby amended by
deleting Section 4.9, Health Approval and replacing it with the following:
"4.9 SEWAGE DISPOSAL APPROVAL
Where the issuance of a permit for a building or structure or
change of use of an existing building or structure may affect any
sewage system either on the subject lands or adjacent lands or any
water supply, no building permit shall be issued for such building or
structure unless the building permit application is accompanied by
an approved permit for the proposed method of sewage disposal in
accordance with the Building Code Act for systems with a design
capacity of less than 10,000 litres (2,200 gallons) per day, or from
the Ministry of the Environment and Energy for systems with a
design capacity of greater than 10,000 litres (2,200 gallons) per
day."

By-law No. 82-08, as amended, being the Comprehensive Zoning By-law
for the Corporation of the Township of Kincardine, is hereby amended by
deleting Section 6.13, Watercourse Setbacks and replacing it with the
following:
6.13 WATERCOURSE SETBACKS
6.13.1 Municipal Drains
Notwithstanding any yard provisions of this By-law, except as
otherwise provided no person shall hereafter erect any
permanent building or structure in any zone which is:
(a) closer than 15 metres (49.2 feet) from an open municipal
drain as defined in the Municipal Drainage Act, RS.O. 1990;
or,
(b) closer than 15 metres (49.2 feet) from an open municipal
drain as defined in the Municipal Drainage Act RS.O. 1990;
or, notwithstanding the above, no setback shall be required
for public facilities such as drainage culverts, municipal,
county or provincial bridges and other similar public facilities.
6.13.2 Natural Watercourses
Notwithstanding any yard provisions of this By-law, except as
otherwise provided, no person shall hereafter erect any
permanent building or structure in any zone which is:
(a) closer than 15 metres (49.2 feet) from a watercourse shown
on Schedule "A" to this by-law. Notwithstanding the above
no setback shall be required for public facilities such as
drainage culverts; municipal, county or provincial bridges
and other similar facilities."
9. By-law No. 82-08, as amended, being the Comprehensive Zoning By-law
for the Corporation of the Kincardine, is hereby amended by deleting
Subsection 5.60, Definitions, Home Occupation and replacing it with the
following:
5.60 "HOME OCCUPATION" shall mean an occupation for gain or
support conducted entirely within a dwelling unit, or in the case of
an agricultural business or a trades person business may be
carried out within an accessory building."
10. By-law No. 82-08, as amended, being the Comprehensive Zoning By-law
for the Corporation of the Township of Kincardine, is hereby further
amended by deleting Section 6.25, General Provisions, Home
Occupations, and replacing it with the following:
"6.25 HOME OCCUPATION - DOMESTIC AND HOUSEHOLD ARTS
Where listed as a permitted use, a home occupation domestic or
household art may be conducted within a dwelling unit and may
include dressmaking, instruction in music, dancing, arts and crafts
to not more than six pupils or students at anyone lesson, tailoring,
weaving, painting, sculpting, furniture refinishing and repair, and
moulding or otherwise making or repairing of garden or household
ornaments, articles of clothing, personal effects or toys provided
that:

(a) There is no display of goods or advertising other than a plate
or sign which is not larger than 0.4 square metres (4.3 square
feet) in area, not flashing.
(b) The occupation is carried on by a member of the family
residing on the premises and all articles sold are produced by
members of the family.
(c) There shall be not more than one (1) assistant who is not a
resident in the building.
(d) No mechanical equipment is used except that reasonably
consistent with the use of a dwelling.
(e) Not more than twenty-five percent (25%) of the gross floor
area of the dwelling is devoted to the occupation.
(f) The said dwelling unit is occupied as a place of residence by
the individual operating the home occupation.
(g) There is no external storage of goods or material.
(h) One off-street parking space is provided for every 19 square
metres (204.5 square feet) of floor space occupied by the
home occupation.
(i) The residential character of the dwelling is not changed.

6.25.2 HOME OCCUPATION.. PROFESSIONAL USES
Where listed as a permitted use, Home Occupation - Professional
Use may be carried on within a dwelling unit by professional
practitioners such as trades persons, lawyers, notaries, realtors,
medical practitioners, chiropractors, dentist, veterinarians,
photographers, professional, consultants, and hair dressers for
professional purposes provided that:
(a) The said dwelling is occupied as a residence by the
professional user.
(b) There shall be not more than one (1) assistant who is not a
resident in the building.
(c) Not more than twenty-five (25%) percent of the gross floor
area is devoted to the home occupation.
(d) There shall be no advertising other than a plate or sign which
is not flashing and not larger than 0.4 square metres (4.3
square feet) in area.
(e) One off-street parking space is provided for every 19 square
metres (204.5 square feet) of floor space occupied by the
professional use;
(f) The residential character of the dwelling is not changed;
(g) There is no external storage of goods or materials; and,
(h) Notwithstanding Section 6.25.2, where the Home Occupation-
Professional is in the form of a trades person business, the
storage of equipment and material necessary to conduct the
home occupation shall be permitted within an accessory
building.

6.25.3 HOME OCCUPATION - AGRICULTURAL BUSINESS
Where listed as a permitted use, a home occupation agricultural
business may be conducted within a dwelling, a farm building or
an accessory building and shall be limited to welding, seed
dealing, small machinery repair, cabinet making, furniture making
ir repair, carpentry, the sale and service of equestrian equipment
and a trades person business, provided that:
(a) There is no advertising other than a plate or sign which is not
flashing and not larger than 1 square metre (10.8 square feet)
in area and not flashing.
(b) The occupation is conducted by a member of the family
residing on the premises and all articles are produced and lor
sold by members of the family and all services are provided by
members of the family, except for the employment of one
assistant.
(c) Where the home occupation is located within a dwelling, not
more than twenty-five (25) per cent of the total floor area is
devoted to such use.
(d) Where the home occupation is located within an accessory
building, not more than 100 square metres (1076.4 square
feet) shall be devoted to such use.
(e) There is no outside storage of goods, materials or equipment
unless a planting strip is provided for, in accordance with the
"Rural Commercial Zone".
(f) Such home industry is clearly secondary to the main
agricultural use and does not change the agricultural character
of the area.

6.25.4 HOME OCCUPATION - FARM VACATION
Where listed as a permitted use, a home occupation farm vacation
business may be conducted within a farm dwelling provided that:
(a) The lot and detached dwelling in which the Home Farm
Vacation establishment is located must meet all the
requirements of the zone in which it is located.
(b) No person, other than members of the family who operate the
establishment shall be employed except as is necessary for
housekeeping purposes.
(c) Each guest room shall have a minimum floor area of 10.5
square metres (113 square feet).
(d) Guest rooms are not permitted within an attic.
(e) No Home Farm Vacation shall provide more than 3 guest
rooms for overnight accommodation.
(f) No food or drink shall be offered or kept for sale for persons
who are not guests of the establishment.
(g) A sign shall be permitted provided such sign is not greater
than 0.4 square metres in area (4.3 square feet).
(h) A maximum of eight (8) guests shall be permitted to stay at
the same time within a Home Farm Vacation.

6.25.5 BED AND BREAKFAST
Where listed as a permitted use, a bed and breakfast business
may be conducted within a detached dwelling provided that:
(a) The lot and detached dwelling in which the Bed and Breakfast
establishment is located must meet all the requirements of the
zone in which it is located.
(b) No person, other than members of the family who operate the
establishment shall be employed except as is necessary for
housekeeping purposes.
(c) Each guestroom shall have minimum floor area of 10.5 square
metres (113 square feet).
(d) Guestrooms are not permitted within an attic.
(e) No Bed and Breakfast shall provide more than 3 guestrooms
for overnight accommodation.
(f) No food or drink shall be offered or kept for sale for persons
who are not guests of the establishment.
(g) A sign sh~1I be permitted provided such sign is not greater
than 0.4 square metres in area (4.3 square feet).

By-law No. 82-08, as amended, being the Comprehensive Zoning By-law
for the Corporation of the Township of Kincardine, is hereby further
amended by adding the following permitted uses to Section 9.1 (b), A1
Permitted Uses:
Home occupation - domestic and household arts
Home occupation - professional use
Home occupation - agricultural business
Home occupation - farm vacation
Bed and Breakfast
12. By-law No. 82-08, as amended, being the Comprehensive Zoning By-law
for the corporation of the township of Kincardine, is hereby further
amended by adding the following permitted uses to Sections 12.1(b), R1
Permitted Uses, 11.1 (b), R2 Permitted Uses; and 12.1 (b), R3 Permitted
Uses:
"Home occupation - domestic and household arts
Home occupation - professional use
Bed and Breakfast"
13. By-law No. 82-08, as amended, being the Comprehensive Zoning by-law
for the Corporation of the Township of Kincardine, is hereby further
amended by deleting Section 6.4, Non-Complying Uses, and replacing it
with the following:
"6.4 NON - COMPLYING USES
6.4.1
Rebuildina. ReDaìrs and Renovations
Nothing in this By-law shall prevent the rebuilding, repair or
renovation of a non-complying use, building or structure which has
been damaged or destroyed by fire or natural disaster providing
that such rebuilding, repair or renovation does not further
contravene this By-law.

6.4.2 Additions and Accessory Uses Permitted
Nothing in this By-law shall prevent an accessory use, extension or
an addition being made to a building or structure which is used for
a purpose specifically permitted within the zone in which such
building or structure is located and which building or structure
legally existed at the date of passing of this By-law but which
building or structure does not comply with one or more of the Zone
Provisions of this By-law, provided such accessory use, extension
or addition does not further contravene any of the provisions of this
by-law."

for the Corporation of the Township of Kincardine, is hereby further
amended by deleting "general store" and "automobile service station"
from the list of permitted uses in Section 23.1 (b) Rural Commercial
Permitted Uses.
15. By-law No. 82-08, as amended, being the Comprehensive Zoning By-law
for the Corporation of the Township of Kincardine, is hereby further
amended by adding the following uses as permitted uses in Section 23.1
(b), Rural Commercial Permitted Uses:
" - kennels
- feed mills
- grain elevators andlor grain drying establishments
- saw mills
- abattoirs"
16. By-law No. 82-08, as amended, being the Comprehensive Zoning By-law
for the Corporation of the Township of Kincardine,. is hereby further
amended by deleting "industrial uses including only, machine shops,
welding shops, blacksmith shops, wood fabricating and comment
fabricating", "buildings and contractor yards and building supplies", fuel
storage establishments", and "terminals for the storage and handling of
freight" from the list of permitted uses in Section 25.1 (b) Rural Industrial
Permitted Uses.
17. By-law No. 82-08, as amended, being the Comprehensive Zoning By-law
for the Corporation of the Township of Kincardine, is hereby further
amended by adding the following uses as permitted uses in Section 25.1
(b), Rural Industrial Permitted Uses:
" - sawmill
- grain elevators andlor grain drying establishments
- abattoirs
- feed mills
- veterinary clinic"
18 By-law No. 82-08, as amended, being the Comprehensive Zoning By-law
for the corporation of the Township of Kincardine is hereby further
amended by deleting "an existing pit" and an "existing quarry" from the
permitted uses of Section 26.1(b), Extractive Industrial Permitted uses,
and By adding "a pit" and "a quarry" as permitted uses in Section 26.1 (b),
Extractive Industrial.

for the Corporation of the Township of Kincardine is hereby further
amended by deleting the Zoning Schedules "A", "B", "C", and "D" and
replacing them with the revised Schedule "A" numbers 1 to 11, as
attached to this By-law.

20. By-law No. 82-08, as amended, being the Comprehensive Zoning By-law
for the Corporation of the Township of Kincardine, is hereby further
amended by adding Schedule B and Schedule C, as attached, to this By-
law.
21. This By-law takes effect from the date of passage by Council and comes
into force and effect pursuant to the provisions of the Planning Act, 1990.
22. This by-law may be cited as the "Township of Kincardine Housekeeping
By-law".
