HomeMy WebLinkAbout06 053 Agree Paisley Fire Dis e e e e THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE KBT BY-LAW NO. 2006 . 053 BEING A BY·LAW TO ENTER INTO AN AGREEMENT FOR COMMUNICATIONS AND DISPATCH SERVICES FOR THE PAISLEY & DISTRICT FIRE DEPARTMENT WHEREAS Section 2 (6) of the Fire Protection and Prevention Act, Chapter 4, Statutes of Ontario, 1997, authorizes municipalities to enter fire protection agreements with other municipalities to provide and/or receive fire protection services; AND WHEREAS Section 20 of the Municipal Act, 2001, S.O. 2001, c. 25 provides that a municipality may enter into agreements with one or more municipalities to jointly provide for their joint benefit any matter which they have the power to provide within their own boundaries; AND WHEREAS the Paisley & District Fire Department provides fire protection in certain areas of the Municipality of Kincardine as well as the Municipality of Arran- Elderslie, the Municipality of Brockton and the Town of Saugeen Shores; AND WHEREAS the Municipality of Kincardine is a member of the Paisley & District Fire Department Joint Board of Management; AND WHEREAS the Paisley & District Fire Department Joint Board of Management has determined that dispatch services for the Paisley Fire Department be provided by the Hanover Police Service Board dispatch in order to increase radio contact with dispatch and to increase service to a modified dispatch; AND WHEREAS the Council for The Corporation of the Municipality of Kincardine deems it advisable to enter into an agreement with the Hanover Police Services Board; the Paisley and District Fire Department Joint Board of Management; and the joint municipalities served by the Paisley & District Fire Board; NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the Corporation of the Municipality of Kincardine enter into a joint agreement with The Corporation of the Municipality of Arran-Elderslie; The Corporation of the Municipality of Brockton, the Corporation of the Town of Saugeen Shores; the Paisley & District Fire Department Joint Board of Management and the Hanover Police Services Board for the provision of twenty-four hour communications and dispatch services to be provided to the Paisley & District Fire Department. . . ./2 e e e e Page 2 Paisley & District Fire Dept. That this by-law shall be subject to the approval of the attached Schedule "A" by all parties. 4. This by-law shall come into full force and effect upon its final passage. 5. Calls received by the Board's Dispatch Centre through 9-1-1 or other telecommunications means will be promptly acknowledged and dispatched through a modified dlspald1lng system. 2. The Department will provide a signed COpy of the Letter of Agreement between the Municipalities and C.A.C.C. prior to initiating this agreemenl 5. The Municipalities will consult with the Board prior to amanding a Letter of Understanding previously referred to, between the CAC.C. and the Munlclpalltias. . 6. The Department will provide the Board with a current call-out list of firefighters In the event a page-out is unsuccessful after two attempts. 7. The Dispatcher will, In the event of a falluns to successfully dispatch finsfighters to a reported emergency, initiate the process of contacting finsflghters fIom the list provided by the Departmenl 8. Once contact is made and the emergency message relayed, the finsfighter dlspald1ed will be responsible for contacting additional assistance required to assist with the emergency. Any defect or condition thai may cause a falluns in the system shall be reported to the Chief of Police of the Hanover Police Service immediately. 11. The Department agrees to pay for the cost of any telephone lines required or long distance calls made by the Board on behalf of the Department relative to emergency dispatch servicas. Such costs will become due and payable upon receipt of an Invoice. 12. If either party to this agreement wishas to terminate the agreement It shall give a ninlmum of six months notice In writing of Its Intention to do so. Termination shall become effective six months from the dete notice Is given and may only be extended In monthly Increments and with the approval of both parties. Both parties to the agreement 1118 bound by the terms of this agreement until the date of termination. 13. The cost to the Department for the modified dispatch service Is set at $1.35 per capita annually and is 1 . J. to be based on current population data obtained through The OntariD Municipal Directory. The fee. for any part of a calendar year will be pro-rated on a monthly basis. 14. The Board agrees to provide the service covenId by this agreement for the stated fee until December 31" 2006 after which the partias to this agreement may consent, in writing, to confirm or re-negotiate the fee for service, which shall not require an amendment to this agreement 15. Billing for this service will be provided in January of each year and is due and payable on receipt of Invoice. ·"He;:' 16. The most recent population figure available for the purposes of calculating the fee for service, for the entirety of the Paisley & District Fire Department area of responsibility, Is two thousand, six hundred (2,600). ië~~~~~:'~~~iÍg~t:::~=='::n=:.-;,:=: reimbursement for any part thereof. . . 1f,k The Board will, during the. term of this ~~t, exercise due diligence in providing the agreed upon level of$8lVice and operition of the serviCe. 19. The parUes agree that the Board shall have no liability to the Municipality as a result of the failure of the system to operate, or as a result of any act or omission by any employee in the operation of the $8/d,.1I~m. 20. a) The Municipality agrees to Indemnify and hold hannlass the Board, its employees, agents and servants and the Chief of Police from all manner of actions, causes of actions, suits, claims and demands whatsoever that may be made against them as a rasult of the performance of their duties on behalf of the Municipality and as agreed to In this agreement b) The Board agrees to Indemnify and hold harmless the Municipality, Its employees, agents and servants and the Fire Chief from all manner of actions, causes of actions, suits, claims and demands whatsoever that may be made against them as a result of the Board's performance of its duties on behalf of the Municipality and as agreed to In this agreement 21. a) . The Municipality shall provide liability Insurance minimally In the amount of two million dollars to Insure the Indemnity contained In this agreement and shall ensure that the Board is stated In the çontractof Insurance as a co-Insured. The Department will provide a signed copy of the Letter of Agreement between the Municipalities and C.A.C.C. prior to Initiating this agreement. 5. The Municipalities will consult with the Board prior to amending a Letter of Understanding previously referred to, between the C.A.C.C. and the Municipalities. . 6. The Department will provide the Board with a current call-out list of firefighters In the event a page-out Is unsuccessful after two attempts. 7. The Dispatcher will, In the event of a failure to successfully dispatch firefighters to a reported emergency, Initiate the process of contacting firefighters from the list provided by the Department. 8. Any defect or condition that may cause a failure In the system shall be reported to the Chief of Police of the Hanover Police Service Immediately. 11.
