HomeMy WebLinkAbout00 120 HwyDedi Pt lot 8,9 con 5 - e e e THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2000 -120 A BYLAW CONFIRMING THE ACQUISITION OF LAND FOR HIGHWAY WIDENING PURPOSES AND ESTABLISHING THE SAME AS PART OF THE PUBLIC HIGHWAY SYSTEM FOR THE MUNICIPALITY OF KINCARDINE WHEREAS pursuant to the Municipal Act, R.S.O. 1990, chapter M.45, Section 191(1), the Council of every municipality may pass by-laws for acquiring land for municipal purposes. AND WHEREAS pursuant to the said Municipal Act, section 297(1) (b) the Council of every municipality may pass by-laws for widening any highway or part of a highway. AND WHEREAS the Corporation of the Municipality of Kincardine has from time to time acquired land for the purposes of widening and improving the existing public highway system of the Municipality of Kincardine. AND WHEREAS it is desirous to confirm the acquisition of the land as part of the public highway system of the Municipality of Kincardine. NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the acquisition of the lands described in the schedule attached to this by-law is hereby confirmed and approved. That the said lands described in the schedule "A" attached to this by-law are hereby acquired for highway widening purposes and are accepted and dedicated as part of the public highway system of the Municipality of Kincardine. That this by-law shall become effective upon its final passage by the Council of the Municipality of Kincardine and upon its registration in the Registry Office for the Registry division of Bruce (No.3) This by-law may be cited as the "Highway Dedication By-law (Part Lot 8, and Part Lot 9, Concession 5, former Township of Kincardine)". 2. 3. 4. READ a FIRST, SECOND and THIRD time and DEEMED TO BE PASSED this 11th day of October, 2000. 4 ~ Mayor Highway Dedication By-law By-law 2000-120 Schedule "A" Those lands and premises located in the following municipality, namely in the Municipality of Kincardine, in the County of Bruce and being more particularly described as follows: Firstly: Part of Lot 8, Concession 5, shown as Part 15 on a Plan of Survey deposited as Plan 3R-1640 (former Township of Kincardine) now in the Municipality of Kincardine; Secondly: Part of Lot 9, Concession 5, shown as Part 14, on a Plan of Survey deposited as Plan 3R-1640 (former Township of Kincardine) now in the Municipality of Kincardine.
