HomeMy WebLinkAbout00 017 Nut.Mgmt Interim Control e e e e THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2000 -17 BEING A BY-lAW TO EXTEND BY-LAW 1999-109, AS AMENDED, BEING A BY-lAW TO REGULATE THE USE OF LANDS IN THE AGRICULTURAL ZONES OF THE MUNICIPALITY OF KINCARDINE (FORMERLY KINCARDINE-BRUCE-TIVERTON) FOR INTENSIVE LIVESTOCK FARM OPERATIONS ON AN INTERIM CONTROL BASIS WHEREAS the Council of The Corporation of the Township of Kincardine-Bruce- Tiverton enacted By-law No. 1999-109 on the Sth day of September, 1999 being an Interim Control By-law to regulate the use of lands in the agricultural zones of the Municipality of Kincardine for intensive livestock farm operations; AND WHEREAS by-law 1999-109 was amended on the 22"d of September, 1999 by By-law 1999-113. AND WHEREAS The Township of Kincardine-Bruce-Tiverton did hire the County of Bruce Planning Department to do a study to determine appropriate land-use and site evaluation procedures and policies and to regulate and govern nutrient management issues including the construction or expansion of intensive livestock operations and/or liquid manure pits in the Municipality of Kincardine. AND WHEREAS the study results as of December is, 1999 had 35 recommendations which would take considerable time to address. AND WHEREAS recommendation #35 of the Draft Report of Kincardine-Bruce- Tiverton Management Project Goals, Objectives and Actions states: "The Committee recommends to Council to the majority of the recommendations presented in this report be implemented as soon as possible. Many of the recommendations can simply be incorporated into the Nutrient Management By-law. However the Interim Control By-law should be extended until the NMP By-law, zoning and other municipal legislative requirements as recommended in this report are put in place.' AND WHEREAS by Bill Pr15 which received Royal Assent on December 31, 1999 the name of The Corporation of the Township of Kincardine-Bruce-Tiverton was changed to The Corporation of the Municipality of Kincardine. AND WHEREAS the Council of The Corporation of the Municipality of Kincardine deems it advisable to amend the Interim Control By-law, as amended to extend the period covered by the by-laws as per section 38(2) of The Planning Act R.S.O. 1990 c. P.13 as amended. AND WHEREAS section 3S(2) of The Planning Act R.S.O. 1990 c. P.13 allows the by-law to be extended to cover a total period up to two (2) years. ...21 e e e e By-Law No. 2000 - 17 Extension to Interim Control By-law Page 2 of 2 AND WHEREAS the Council of the Corporation of the Municipality of Kincardine wishes to extend the Interim Control By-law to the maximum period of two (2) years. NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the Interim Control By-law 1999-109, as amended, by extended to September 8, 2001. 2. This by-law shall come into full force and effect on its final passing. 3. This by-law may be cited as the "Extension to the Nutrient Management Interim Control Amendment By-law.'
