THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2000-125
A BY-LAW TO AMEND ZONING BY-LAW NO. 1988"(1, BEING THE
COMPREHENSIVE ZONING BY-LAW FOR THE MUNICIPALITY OF KINCARDINE
(FORMER TOWN OF KINCARDINE) - COADY - LOT 23, REGISTERED
PLAN 3M-145 (780 REYNOLDS DRIVE)
WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes the
Councils of municipalities to enact and amend zoning by-laws which comply with an
approved official plan;
AND WHEREAS the Council of the Corporation of the Town of Kincardine has enacted
By-law 88-01, a zoning by-law enacted under Section 34 of the said Planning Act;
AND WHEREAS the Council of the Corporation of the Municipality of Kincardine
desires to amend By-law 88-01 ;
NOW THEREFORE the Council of the Corporation of the Municipality of Kincardine
ENACTS as follows:
1) Schedule 'A" to By-law No. 88-01, as amended, is hereby further amended by
changing thereon the zoning designation of Part of Block 38, Registered Plan
3M-145, Reference Plan 3R-5536, (former Town of Kincardine), Municipality of
Kincardine from (D-Development) to (R1-Residential) and Lot 23, Registered
Plan 3M-145 (780 Reynolds Drive), (former Town of Kincardine), Municipality of
Kincardine from (R 1-Residential) to (R 1-15) as shown on the Schedule 'A'
attached hereto.
2)
Notwithstanding their 'R1' zoning designation, the lands delineated as 'R1-15" on
Schedule 'A' to this by-law may be used for residential purposes in accordance
with the 'R1' zone provisions contained in this by-law, excepting however that:
(i) the 'minimum side yard' on the south side shall be no less than 20
centimetres (8 inches) to recognize the existing deck.
3) This by-law takes effect from the date of passage by Council and comes into
force and effect pursuant to the provisions of the Planning Act, 1990.
4) This by-law may be cited as the "Amendment to By-law 1988-01 (Coady - Lot 23,
municipally known as 780 Reynolds Drive, Municipality of Kincardine (former
Town of Kincardine))".
READ a FIRST, SECOND and a THIRD time and DEEMED TO BE PASSED this
18th day of October, 2000. .
