Being a By-law to Establish, Assume and Name Institute Road as Part of the
Public Highway System for the Municipality of Kincardine
Whereas pursuant to Municipal Act, 2001, S.O, 2001, c.25, as amended, Sections 8(1)
and 9 provide that the powers of a municipality under this or any other Act shall be
interpreted broadly so as to confer broad authority on the municipality to enable the
municipality to govern its affairs as it considers appropriate and to enhance the
municipality's ability to respond to municipal issues and has the capacity, rights, powers
and privileges of a natural person for the purpose of exercising its authority under this or
any other Act; and
Whereas Sections 11 (3) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, gives
lower tier municipalities the power to pass by-laws within the sphere of jurisdiction dealing
with highways; and
Whereas Section 31 (2) of the Municipal Act, S.O. 2001, c.25, as amended, provides
after January 1, 2003, land may only become a highway by virtue of a municipal By-law
establishing the highway; and
Whereas The Corporation of the Municipality of Kincardine is the owner of the lands
described in Schedule "A" of this By-law; and
Whereas the Council of the Municipality of Kincardine deems it advisable to rename
Cedar Lane and Red Pine Street; and
Whereas it is deemed appropriate to establish and assume the lands described in
Schedule "A" of this By-law as public highways for public use; now therefore be it
Resolved that the Council of The Corporation of the Municipality of Kincardine Enacts
as follows.-
1 . That the lands described in Schedule "A° to this By-law are hereby established and
assumed as public highways under the jurisdiction of The Corporation of the
Municipality of Kincardine.
2. That that the lands described as CEDAR LANE PL 485; KINCARDINE (PIN 33284-
0143) be known as "Institute Road Extension".
3. That the lands described as RED PINE ST PL 485; KINCARDINE (PIN 33284-0141),
be known as "Institute Road".
4. That the Mayor and Clerk are hereby authorized to execute the necessary documents
to fulfill the intent of this By-law.
5. That this By-law shall come into full force and take effect upon third and final reading
thereof.
6. This by-law may be cited as the "Assume, Establish and Name Institute Road By-law"
Read a First, Second and Third Time and Finally passed this 12th day of June, 2024.
