THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE
BY-LAW
NO. 2000 - 65
BEING A BY-LAW TO AMEND BY-LAW NO. 1988-1, AS AMENDED,
BEING THE COMPREHENSIVE ZONING BY-LAW FOR
THE (FORMER) TOWN OF KINCARDINE, 1387403 ONTARIO LTD. - PART
LOTS 16 & 17, SOUTH OF DURHAM STREET, LOTS 16, 17, & PART OF LOT
18 NORTH OF LAMBTON STREET, PART OF LOTS 2 & 3, PLAN 133,
REFERENCE PLAN 3R-3572 (KNOWN MUNICIPALLY AS
855 PRINCES STREET) MUNICIPALITY OF KINCARDINE
WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapter 13 authorizes
the Councils of Municipalities to enact and amend zoning by-laws which comply
with an approved official plan;
WHEREAS the Council of the Corporation of the Town of Kincardine has
enacted By-law 1988-1, a zoning by-law enacted under Section 34 of the said
Planning Act;
AND WHEREAS the Corporation of the Town of Kincardine has restructured to
now be a part of the Corporation of the Municipality of Kincardine;
AND WHEREAS the Council of the Corporation of the Municipality of Kincardine
desires to amend By-law 1988-1;
NOW THEREFORE the Council for The Corporation of the Municipality of
Kincardine ENACTS as follows:

That Schedule "A" to the Town of Kincardine Zoning By-law No. 1988-1,
as amended, is hereby further amended by changing therein the zoning
designation of Part Lots 16 & 17, South of Durham Street, Lots 16, 17, &
Part of Lot 18 North of Lambton Street, Part of Lots 2 & 3, Plan 133,
Reference Plan 3R-3572, known municipally as 855 Princes Street,
(former Town of Kincardine), Municipality of Kincardine from 'R4-2' to 'R3-
10-H' as shown on the Schedule "A" attached hereto.

By-law No. 1998-1, as amended, being the Comprehensive Zoning By-law
for the Town of Kincardine, is hereby further amended by adding the
following paragraphs to subsection 5.3.11:
5.3.11.10 Notwithstanding their 'R3-Residential' zoning designation, the
lands delineated as 'R3-10-H' on Schedule "A" to this by-law
may be used for residential purposes in accordance with the
'R3-Residential' zone provisions contained in this by-law,
excepting however that:
(i) the minimum exterior side yard shall be no less than 4.2
metres;
(ii) minimum rear yard shall be no less than 5.2 metres for the
southerly-facing buildings;
(iii) the front yard shall be deemed to be the lot line which abuts
Princes Street;

(iv) a Holding symbol 'H' will be placed on the lands which will be
removed subject to the execution of a site plan control
agreement between the owner and the Municipality;
(v) all future development must comply with requirements of the
by-law.
This by-law shall come into force and effect on the final passing thereof by
the Council of the Municipality of Kincardine subject to compliance with
the provisions of the Planning Act, 1990, as amended.
This by-law may be cited as the "Amendment to Comprehensive Zoning
By-law 1988-1, 855 Princes Street (1387403 Ontario Ltd.)".
4.
READ a FIRST, SECOND and THIRD time and DEEMED TO BE PASSED this
1 ¡th day of May, 2000.
