HomeMy WebLinkAbout00 126 Amend No. 88-01 Ont Ltd. - e e e THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2000 -126 BEING A BY-LAW TO AMEND BY-LAW NO. 1988-1, AS AMENDED. BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE (FORMER) TOWN OF KINCARDINE, AND ITS AMENDING BY-LAW #2000-65, FOR 1387403 ONTARIO LTD., - PART LOTS 16 & 17, SOUTH OF DURHAM STREET, LOTS 16, 17 & PART OF LOT 18 NORTH OF LAMBTON STREET, PART OF LOTS 2 & 3, PLAN 133, REFERENCE PLAN 3R-3572 (KNOWN MUNICIPALLY AS 855 PRINCES STREET). MUNICIPALITY OF KINCARDINE WHEREAS Section 43 of the Planning Act, R.S.O. 1990, states that Subsections 34(12) to (34) do not apply to a By-law that amends a By-law only to express a word, term or measurement in the By-law in a unit of measurement set out in Schedule 1 of the Weights and Measures Act (Canada) in accordance with the definitions set out in Schedule II of that Act and that, a) does not round out any measurement so expressed further than to the next higher or lower multiple of 0.5 metres or 0.5 square metres, as the case may be; or b) does not vary by more than 5 per cent any measurement so expressed, 1993, c.26, s.55. AND WHEREAS the Council of the Corporation of the Municipality of Kincardine has enacted By-law 2000-65, a zoning amendment to the Comprehensive Zoning By-law 1988-01 enacted under Section 34 of the said Planning Act with a minimum exterior side yard setback of no less than 4.2 metres; AND WHEREAS the Council of the Corporation of the Municipality of Kincardine desires to amend the Comprehensive Zoning By-law 1988-01 and the amending By-law 2000-65 to provide for a minimum exterior side yard setback of no less than 4 metres; NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine ENACTS as follows: 1. By-law No. 2000-65, is hereby further amended by adding the following paragraphs to subsection 5.3.11: 5.3.11.10 Notwithstanding their 'R3-Residential' zoning designation, the lands delineated as "R3-10-H' on Schedule 'A' to this by- law may be used for residential purposes in accordance with the 'R3-Residential' zone provisions contained in this by-law, excepting however that: (i) the minimum exterior side yard shall be reduced from 4.2 metres to no less than 4.0 metres on the south side of the subject lands. .../2 e e e e Amending By-law to Zoning Amendment By-law No. 2CJ00..65, for 855 Princes St., 13887403 Ontario Ltd. This By-law shall come into force and effect on the final passing thereof by the Council of the Municipality of Kincardine, subject to compliance with the provisions of the Planning Act, R.S.O. 1990, as amended. 3. This By-law may be cited as "Amending By-law to Zoning Amendment By-law #2000-65, for 855 Princes St., 1387403 Ontario ltd'-.
