THE CORPORATION OF THE MUNICIPALIlY OF KINCARDINE
BY-LAW
BY-LAW NO. 2001 - 07
BEING A BYLAW TO AMEND BY-LAW 1999-80 TO PROVIDE AN
ADDENDUM TO THE EXISTING AGREEMENT WITH THE SOLICITOR
GENERAL RESPECTING POLICING ADEQUACY REQUIREMENTS
WHEREAS the Council for The Corporation of the Municipality of Kincardine
passed by-law number 1999-80 to enter into a contract for the provision of police
services with the Ontario Provincial Police;
AND WHEREAS Council deems it advisable to amend the agreement forming
part of this by-law;
AND WHEREAS the Police Services Act and Regulation defines the minimum
standards of adequate and effective policing services the Municipality must
provide for its citizens.
NOW THEREFORE the Council for The Municipality of Kincardine ENACTS as
follows:
1. The Council for the Corporation of the Municipality of Kincardine .enter into
an Agreement to Amend the existing policing services agreement with
respect to the provision of adequate and effective policing services under
Section 10 of the Police Services Act, RSO 1990, c. P.15, such
Addendum attached hereto as Schedule "A".
2.
The Mayor and Clerk be authorized to sign on behalf of the Corporation of
the Municipality of Kincardine the Addendum to the Agreement with the
Solicitor General which is attached to this by-law and to affix the
Corporate Seal.
3. That this by-law shall come into full force and effect upon its final passage.
4. That this by-law may be cited as the "OPP, Police Services Agreement
Amendment, By-law".

UNDER SECTION 10 OF THE POLICE SERVICES ACT. R.S.O. 1990, c. P.lS, as am.
BETWEEN THE SOLICITOR GENERAL OF ONTARIO AND
THE CORPORATION OF THE Municipalitv OF Kincardin..
AGREEMENT
BETWEEN:
THE CORPORATION OF THE Municipa1itv OF Kincardin..
(the "Municipality")
AND:
THE ONTARIO PROVINCIAL POLICE
(the "a.p.p. ")
WHEREAS:
The Police Services Act and Regulation defines the minimum standards of adequate and effective
policing services the Municipality must provide for its citizens and;
The Municipality discharged this duty by entering into a contract with the a.p.p. to provide such
services and;
Pursuant to S. 10 Police Services Act the Municipality established a Police Services Board to
discharge certain responsibilities relating to the provision of Policing Services by the a.p.p.
pursuant to this contract;
THEREFORE: The Parties Agree that;
The a.p.p. shall undertake and be responsible for ensuring that all mandatory standards of adequate
and effective police services as required by Ontario Regulation 3/99 are completed and in place
within the legislated time ftame and;
The Police Services Board shall be provided with sufficient documentation, as agreed upon between
the board and the a.p.p., to allow the board to evaluate the services and satisfy itself that adequate
and effective standards and policies are in place;
AND FURTHER:
It shall be the responsibility of the Police Services Board to monitor the delivery of policing
services to ensure that the provisions of Ontario Regulation 3/99 are satisfied on an ongoing basis.

Please find attached three (3) copies of the completed Addendum to the Agreement for Policing
Services between the Municipality of Kincardine and the Ontario Provincial Police (OPP).
! A copy of the Addendum should be attached to each of the Region's, detachment's and
4 municipality's copy of the existing policing agreement. Please ensure this distribution is effected
; as soon as possible.
