HomeMy WebLinkAbout01 121 agree 707 queen easement e e . e THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2001 -121 A BY-LAW TO AUTHORIZE THE SIGNING OF A RELEASE OF EASEMENT AGREEMENT WITH ONTARIO HERITAGE FOUNDATION WHEREAS the Council for The Municipality of Kincardine deems it advisable to enter into a Release of Easement Agreement with Ontario Heritage Foundation; AND WHEREAS this Agreement provides for the release and discharge of those lands, more particularly described as part Durham Market Square, Town Plot of penetangore, known municipally as 707 Queen Street, Municipality of Kincardine, County of Bruce, Registry Division of Bruce: Part 2 Plan 3R-2164, from all the easements and covenants in the Easement Agreement made pursuant to section 22 of the Ontario Heritage Act, RS.O. 1980, c.337 and registered on March 31, 1983 as No. 200581; AND WHEREAS Ontario Heritage Foundation was formerly described as The Ontario Heritage Foundation by section 1(d) of the Ontario Heritage Act, RS.O. 1980, c.337, which corporate name was changed by section 1 of the Ontario Heritage Act, RS.O. 1990, c.O.18, which came into force on December 31, 1991; NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the Corporation of the Municipality of Kincardine enter into an agreement with Ontario Heritage Foundation; 2. That the Mayor and CAO be authorized to sign, on behalf of The Corporation of the Municipality of Kincardine, the Agreement with Ontario Heritage Foundation and the Affidavit of Residence of Value of the Consideration and attached to this by-law as Schedule "A" and to affix the corporate seal as and when required. 3. This By-law shall come into full force and effect upon its final passage. 4. This By-law may be cited as the "Release of Easement - 707 Queen Street Agreement, By-law".
