Home My WebLink About06 045 Tender - Gran 'A' Gravel e e e e THE CORPORATION OF THE MUNICIPALITY OF KINCARDINE BY-LAW NO. 2006 - 045 BEING A BY-LAW TO ACCEPT A TENDER TO SUPPLY, LOAD, HAUL AND PLACE GRANULAR "A" MAINTENANCE, CONSTRUCTION & SHOULDER GRAVEL ON ROADS LOCATED WITHIN THE MUNICIPALITY OF KINCARDINE (Donegan's Haulage Limited) WHEREAS Section 44 of the Municipal Act, 2001, 5.0. 2001, c. 25, as amended, provides that a municipality that has jurisdiction over a highway or bridge shall keep it in a state of repair that is reasonable in the circumstances; AND WHEREAS pursuant to the said Municipal Act, Sections 8 and 9 (1) provide municipalities with the powers of a natural person to enable them to govern their affairs as they consider appropriate under this or any other Act and to enhance their ability to respond to municipal issues; AND WHEREAS it has been determined that there is a need to apply Granular "An maintenance, construction and shoulder gravel on various roads within the Municipality of Kincardine; AND WHEREAS the Council for the Corporation of the Municipality of Kincardine deems it expedient to accept a tender to supply, load, haul and place Granular "A" maintenance, construction and shoulder gravel on Municipality of Kincardine roads pursuant to Tender No. 2006-02. NOW THEREFORE the Council for The Corporation of the Municipality of Kincardine ENACTS as follows: 1. That the tender of Donegan's Haulage Limited to supply, load, haul and place Granular "An maintenance, construction and shoulder gravel, in the amount of $323,696.10, including all applicable taxes, be hereby accepted, subject to approval of the relevant capital projects during the 2006 budget deliberations. 2. That the Mayor and CAO be hereby authorized to sign, on behalf of the Council for the Municipality of Kincardine, any contracts and other documents required to authorize such work to commence. 3.
