BEING THE COMPREHENSIVE ZONING BY-LA FOR THE TOWNSHIP OF KINCARDINE Peter Vaughan c/o Scott Thede Lot 29, Concession 12 (being Parts 1 and 2 on RP R-1693), Municipality of Kincardine (former Township of Ki cardlne) WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chap r 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws hich comply with an approved official plan; I AND WHEREAS the Council of the Corporation of the Town~~ip of Kincardine has enacted By-law 82-08, a zoning by-law enacted under Section ~ of the said Planning A~ , I I AND WHEREAS the Corporation of the Township of Kincardine h~S restructured to now be a part of the Corporation of the Municipality of Kincardine; I AND WHEREAS the Council of the Corporation of the Muni ipality of Kincardine desires to amend By-law 82-08; ~ NOW THEREFORE the Council of the Corporation of the Muni ipality of Kincardine ENACTS as follows: , 1. Schedule 'A' to By-law No. 82-08 as amended, is hereby fu her amended by changing thereon from 'A1' to 'A1-20Q4-67a' and 'A1-2004- 7b', the zoning designation of those lands described as Lot 29, Concession 12 (being Parts 1 and 2 on RP 3R-1693), Municipality of Kincardine (former T wnship of Kincardine) which are outlined on the attached Schedule 'A' 2. By-Law No. 82-08, as amended, being the Comprehensive oning By-Law for the Township of Kincardine, is hereby further amended by dding the following paragraphs to Section 9.3 thereof: 9.3.51 (a) Notwithstanding their 'A1' Zoning desig ation, those lands described as Lot 29, Concession 12 (being P rt 1 and part of Part 2 on RP 3R-1693), Municipality of Kincardine (former Township of Kincardine), and delineated as 'A1-2004-67 ' on Schedule 'A' to this By-law may be used for non-farm re idential purposes in compliance with the 'A1' Zone provisions co tained in this By-law, excepting however, that: (i) The number of livestock units shall be imited to 3.7 livestock units per hectare; . . ./2 e . e e By-law No. 2004 - 132 Page 2 By-law 82-08 Zoning Amendment (Lot 29 Concession 12, Parts 1 ~ 2 on RP 3R-1693) 9.3.51 (b) Notwithstanding their 'A1' Zoning desigl'1ation, those lands described as Lot 29, Concession 12 (being par¡t of Part 2 on RP 3R- 1693), Municipality of Kincardine (former Tow.-.ship of Kincardine), and delineated as 'A1-2004-67b' on Schedu,e 'A' to this By-law may be used for general agricultural purposeþ in compliance with the 'A l' Zone provisions contained in thi$ By-law, excepting however, that: (i) The construction of any new resideritial buildings and/or structures of any type shall be prohibite<ll. 3. This By-law takes effect from the date of passage by Council and comes into force and effect pursuant to the provisions of the Planning AÇt, R.S.O. 1990. 4. This By-law may be cited as the "Amendment to Comprehe~sive Zoning By-law 82-08, (Lot 29, Concession 12 (being Parts 1 and 2 on RP 3R-1693), Municipality of Kincardine (former Township of Kincardine», By-Law".
