HomeMy WebLinkAbout04 133 zoning vaughan 2003 25 . e e e 1HE CORPORATION OF 1HE MUNICIPALITY OF KINC INE BY-LAW No. 2004 -133 BEING A BY-LAW TO AMEND ZONING BY-LAW N .2003-25, BEING THE COMPREHENSIVE ZONING BY-LAW FOR THE MUNICIPALITY OF KINCARDINE Peter Vaughan cfo Scott Thede Lot 29, Concession 12 (being Parts 1 and 2 on RP 3 -1693), Municipality of Kincardine (former Township of Kine rdine) WHEREAS Section 34 of the Planning Act, R.S.O 1990, Chapte 13 authorizes the Councils of Municipalities to enact and amend zoning by-laws w ich comply with an approved official plan; AND WHEREAS the Council of the Corporation of the Municipali of Kincardine has enacted By-law 2003-25, a zoning by-law enacted under Sect on 34 of the said Planning Act; AND WHEREAS the Council of the Corporation of the Munici ality of Kincardine desires to amend By-law 2003-25; NOW THEREFORE the Council of the Corporation of the Munic pality of Kincardine ENACTS as follows: 1. Schedule 'A' to By-law No. 2003-25 as amended, is hereby f rther amended by changing thereon from 'M' to 'A1-a' and 'A1-m', the zoning d signation ofthose lands described as Lot 29, Concession 12 (being Parts 1 an 2 on RP 3R-1693), Municipality of Kincardine (former Township of Kincardine) w ich are outlined on the attached Schedule 'A'. 2. By-Law No. 2003-25, as amended, being the Comprehensiv Zoning By-Law for the Municipality of Kincardine, is hereby further amended by dding the following paragraphs to Section 9.3 thereof: 9.3.11 Notwithstanding their 'A l' Zoning design tion, those lands described as Lot 29, Concession 12 (being Pa 1 and part of Part 2 on RP 3R-1693), Municipality of Kincardine former Township of Kincardine), and delineated as 'A1-m' on Sc edule 'A' to this By- law may be used for non-farm residential pu oses in compliance with the 'A1' Zone provisions contained in t is By-law, excepting however, that: (i) The number of livestock units shall be Ii ited to 3.7 livestock units per hectare. 3. This By-law takes effect from the date of passage by Counci and comes into force and effect pursuant to the provisions of the Planning A .
